OBJECTIVE: To provide for public access to waterways located at the Goodland Boating Park by submitting the required Florida Department of Environmental Protection's ("FDEP") fully sovereignty submerged lands lease renewal and modification to increase square footage to the Florida Division of State Lands. CONSIDERATIONS: On July 28, 2009 (Item No. 16D13), the Board approved a Sovereignty Submerged Lands Lease Renewal Lease and Modification to reflect a change in ownership, reflect change in description of use, reflect change in term, increase and reflect correct square footage. The Sovereignty Submerged Lands Lease Renewal Lease and Modification expires on May 5, 2015. On April 16, 2014, a specific purpose survey by FDEP was conducted to delineate the limits of the lease parcel at the Goodland Boating Park. The survey determined an increase in submerged lands from 47,753 square feet to 48,740 square feet. The proposed Sovereignty Submerged Lands Lease Renewal Lease and Modification to Increase Square Footage includes the additional square-feet as well as continues to allow use of 18-slip docking facility, fishing piers and a public boat ramp for an additional 10 years. Parks and Recreation received an invoice for $483.19 for payment based on an increase of 987 square feet of submerged lands. Approval of this item will authorize the Board Chairman to sign the submerged land lease renewal and modification and authorize payment of the invoice. The annual lease fee is $11,359.20 which will be invoiced by DEP separately. FDEP has informed staff that the County will receive a fully executed lease instrument once all fees are paid. If payment is received after March 19, 2015, a 12% late fee penalty may be assessed by FDEP. FISCAL IMPACT: Non-taxable instrument processing fee is $483.19. Funding is available within the Parks and Recreation General Fund (001), Marina Parks Operating Cost Center (156364). LEGAL CONSIDERATIONS: The Sovereignty Submerged Lands Lease Renewal and Modification to Increase Square Footage is substantially identical to past renewal instruments. This item is approved for form and legality and requires a majority vote for Board approval. — JAB Packet Page-1219- 3/10/2015 16.D.12.
