EXECUTIVE SUMMARY Recommendation to approve an extension of two years for completion of subdivision improvements associated with Orange Blossom Ranch Phase 1A(AR-7186) and Orange Blossom Ranch Phase 1B (AR-7431). OBJECTIVE: To have the Board of County Commissioners (Board)approve a two year extension for the completion of subdivision improvements associated with Orange Blossom Ranch Phases 1A and 1B. CONSIDERATIONS: On September 13, 2005 and January 10, 2006, respectively the Board approved the construction plans and final plats for Orange Blossom.Ranch Phase 1A and 1B. The projects are substantially complete and received preliminary acceptance in 2006 and 2007. Section 10.02.05 C.2 requires that construction must be completed within 36 months of approval of a subdivision plat. The Land Development Code allows for 2 — two year extensions. The developer has utilized all of the extensions available to him through the County as well as through certain House Bills and Senate Bills. The owner has requested an extension for completion of construction which would extend the approvals to January 13, 2017 and February 6, 2017. Since this request goes beyond what is allowed in the Land Development Code, the Board of County Commissioners must approve the request. The project approvals expired on January 13,2015 and February 6,2015. FISCAL IMPACT: The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327—Land Development Services Revenue generated by this project: Total: $300.00 Extension Fees GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval.-SAS RECOMMENDATIONS: 1. That the Board accepts the applicant's extension request together with the appropriate fees. 2. Approves a two year extension until January 13,2017 for Orange Blossom Ranch Phase lA (AR-7186)and February 6,2017 for Orange Blossom Ranch Phase 1B (AR-7431)so that the Developer may be incompliance with the time limit requirements of the Land Development Code. 3. The extension approval is subject to the terms and conditions contained in the original approval letter.
