EXECUTIVE SUMMARY Recommendation to authorize the advertisement of an ordinance for future consideration which would amend Ordinance No. 2013-40, the"Collier County Administrator's Ordinance." OBJECTIVE: To revise the County Administrator's Ordinance as directed by the Board. CONSIDERATIONS: Subsequent to deliberation of agenda item 10.A. at the January 27, 2015 County Commission meeting, the Board directed the County Manager to retitle the current division and department structure to achieve technical conformance with Florida Statute. The enclosed ordinance amendment achieves the stated intent of the Board and reflects the enclosed organizational chart that was endorsed by the Board at that meeting. FISCAL IMPACT: Marginal costs will be incurred over time to modify signage, stationery, business cards, etc. GROWTH MANAGEMENT IMPACT: None LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issue, and requires majority vote for approval. -JAK RECOMMENDATION: That the Board authorizes the County Attorney to advertise an ordinance for future consideration that would amend Ordinance No. 2013-40, the "Collier County Administrator's Ordinance,"as outlined in this executive summary. ORDINANCE NO. 2015 - AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AMENDING ORDINANCE NO. 2013-40, THE COUNTY ADMINISTRATOR'S ORDINANCE, BY REQUIRING DEPARTMENT HEADS TO BE CONFIRMED BY THE BOARD; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 125, Florida Statutes, authorizes the Board of County Commissioners to provide for effective administration for the adequate and efficient provision of services to the citizens of Collier County; and WHEREAS, the Board of County Commissioners wishes to amend Ordinance 2013-40, the County Administrator Ordinance, to better track the language of Florida Statutes Sec. 125.74 by requiring that all Department Heads be confirmed by the Board. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that: SECTION ONE: Amendment of Powers and Duties Title and Citation. Section Six (11) of Ordinance No. 2013-40, the Collier County Administrator's Ordinance, is hereby amended to read as follows: (11) Select, employ and supervise all personnel and fill all vacancies, positions or employment under the jurisdiction of the Board except County Attorney. However, the employment of an Assistant County Administrator, the Executive Director of the County Airport Authority and all Division Administrators and all Department Directors shall require confirmation by the Board. SECTION TWO: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION THREE: CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a Packet Page-640- 2/10/2015 16.F.4. separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: EFFECTIVE DATE. This Ordinance shall take effect upon filing with the Florida Department of State.
