EXECUTIVE SUMMARY
Recommendation to appoint members to the Pelican Bay Services Division Board.
OBJECTIVE: To appoint three members representing Residential interests to serve terms
beginning April 1, 2015 and expiring on March 31, 2019, and one member representing
Commercial interests to serve a term expiring on March 31,2018.
CONSIDERATIONS: This 11 member Board was established by Ordinance 2002-27, as
amended. The Division provides landscaping services, including all public road maintenance
and park areas, street lighting services, aquatic management services, beach cleaning, and the
Clam Bay Restoration Project. It is the Division's responsibility to provide the framework of
long-term community planning so that residents can enjoy the benefits of Pelican Bay while
ensuring both the social and financial well being of the Pelican Bay Community. A list of the
current membership is included in the backup.
Two seats representing Commercial interests are currently vacant, and the terms for David
Trecker, John Iaizzo, and Michael H. Levy (all Residential representatives) will expire on March
31, 2015. A press release was issued and applications were received from the following
interested citizens:

The Pelican Bay MSTBU Ordinance provides that "if the number of nominees for the position
which they have been nominated (i.e., for the "residential interests" or for the
"commercial/business/other interests") does not exceed the number of open members for that
position, then there shall be no balloting for such position. Instead, the list of nominees for the
position shall simply be forwarded to the Board of County Commissioners, who, following
public hearing on the matter,will make the necessary appointments to fill said positions." Since
the number of candidates/applicants for the respective positions does not exceed the number of
vacancies(residential and commercial), no election is necessary.

RECOMMENDATION: That the Board of County Commissioners:
1. Reappoints Mr. Trecker representing residential interests, to serve a four-year term
beginning April 1, 2015 and ending on March 31, 2019;
2. Appoints Ms. Bush and Mr. Hirniak, both representing Residential interests, to serve four
year terms beginning April 1, 2015 and expiring on March 31, 2019;
3. Appoints Mr. Schoonmaker, representing Commercial/Business interests, to immediately
fill the remainder of a vacant term expiring on March 31, 2018;
4. Directs the County Attorney to prepare a resolution confirming the appointments; and
5. Directs the County Attorney to continue advertising the remaining Commercial vacancy
on the Pelican Bay Services Division Board.

This 15 member committee was created by Ord. No. 90-111 and amended by Ord. No. 91-22
and 93-15 to aid and assist the County manager and the Board of County Commissioners in
determining the need and quantity of extraordinary law enforcement in Pelican Bay. Also to aid,
assist, and provide input to the County Manager and the Board in effecting a smooth and
expeditious transfer of street lighting,water management and beautification services,
responsibilities and obligations from the Pelican Bay Improvement District. On 11/3/98 the BCC
reduced the membership from 15 to 13 members. Terms are 4 years. On April 11, 2000,the
BCC adopted Ord. No. 2000-22 reducing the membership from 13 members to 11 members.
On 5/28/02 the BCC adopted Ord. 2002-27 establishing the 11 member committee.
Membership shall be 9 representative of the residential interests within the Unit and 2 shall be
representative of the commercial &business interests within the unit.

RESOLUTION NO. 2015—
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, REAPPOINTING DAVID J. TRECKER,
AND APPOINTING PATRICIA JAHNS BUSH, BOHDAN PAUL HIRNIAK,
AND ROBERT W. SCHOONMAKER TO THE PELICAN BAY SERVICES
DIVISION BOARD.
WHEREAS, Collier County Ordinance No. 2002-27, created the Pelican Bay Municipal
Service Taxing and Benefit Unit (Unit) and established the Pelican Bay Municipal Service Taxing and
Benefit Unit Advisory Committee(known as the Pelican Bay Services Division Board); and
WHEREAS, Ordinance No. 2002-27, as amended, provides that the that the Pelican Bay
Services Division Board shall consist of nine members representing the residential interests within the
Unit and two members representing the commercial and business interests within the Unit; and
WHEREAS, there are two current vacancies on the Pelican Bay Services Division Board for
members representing commercial and business interests, and on March 31, 2015, there will be three
additional vacancies for members representing residential interests; and
WHEREAS, four applicants have applied for these positions and, pursuant to Section 122-
1662(f) of the Collier County Code of Laws and Ordinances, no balloting is required, but instead the
nominees' applications shall be forwarded to the Board of County Commissioners to make the
necessary appointments.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that DAVID J. TRECKER, representing
residential interests, is hereby reappointed to the Pelican Bay Services Division Board to serve a four-
year term beginning April 1, 2015 and ending on March 31, 2019, and that PATRICIA JAHNS BUSH
and BOHDAN PAUL HIRNIAK, representing residential interests, are each individually appointed to
the Pelican Bay Services Division Board to serve four-year terms beginning April 1, 2015 and ending
on March 31, 2019, and
BE IT FURTHER RESOLVED that ROBERT W. SCHOONMAKER, representing
commercial and business interests, is hereby appointed to the Pelican Bay Services Division Board to
serve the remainder of a vacant term, beginning January 27, 2015 and expiring March 31, 2018.
