EXECUTIVE SUMMARY Recommendation to approve Second Amendment to the State Housing Initiatives Partnership Program Subrecipient Agreement with Centro Campesino Farmworker Center, Inc. and to recognize a four month extension of the expenditure deadline on Fiscal Year 2011/2012 granted from the Florida Housing Finance Corporation. OBJECTIVE: Provide a housing rehabilitation program to eligible homeowners throughout Collier County. CONSIDERATIONS: On July 7, 1992, the Florida legislature enacted the William E. Sadowski Affordable Housing Act to provide additional funding to local communities to promote and advance affordable housing initiatives. Funds are generated through documentary stamp tax on real estate transactions.Under the State Housing Initiatives Partnership(SHIP)program, Collier County and the City of Naples receive funds from the State of Florida through the Florida Housing Finance Corporation to undertake eligible activities as outlined in the Board adopted Local Housing Assistance Plan. There are two actions recommended in this executive summary. SHIP Subrecipient Agreement: On June 24, 2014, Item 16D1, the Board approved an agreement with Centro Campesino Farmworker Center,Inc. for the administration of an Owner Occupied Rehabilitation Program under the State Housing Initiatives Partnership(SHIP)Program. The project will benefit low and very-low income Collier County homeowners with necessary repairs to their dwelling. Homeowners must occupy their home as their primary residence in order to qualify for assistance. The Board approved the First Amendment to the Subrecipient Agreement at the July 22, 2014 Absentia meeting and ratified at the regular Board of County Commissioners meeting of September 9, 2014 (Item 16F1). The Second Amendment to Subrecipient Agreement recommends the following; • Amend the Budget Narrative (Exhibit B) of the agreement to include an inspection fee to component two of budget line item description to allow for inspection payment and to extend Fiscal Year 2011/2012 expenditure date. The inspection compensation is for those instances whereby the rehabilitation inspection results in determination by the inspector that work requested is not necessary rehabilitation; but, rather, the homeowner has simply failed to conduct routine maintenance. The expenditure deadline for FY 11/12 funding is requested to be extended per the below explanation; and • Amend Exhibit C, D and E of agreement to include inspection fee as part of delivery fee to subrecipient and to make technical revisions; and • Reflect departmental name change The proposed modification has no change to the total funds awarded to the subrecipient or to the project budget. SHIP expenditure extension acceptance: On April 10, 2014, Community and Human Services (CHS) was granted an expenditure extension from the Florida Housing Finance Corporation(FHFC)for Collier County's FY 11/12 SHIP funding from June Packet Page-417- 1/27/2015 16.D.4. 30, 2014 to December 31, 2014. This extension allowed staff time to enter into a subrecipient agreement with an outside organization to administer a residential rehabilitation program under the SHIP program. The six month extension was granted and also approved by the Board on June 24,2014,Item 16D1. On December 12, 2014, staff requested an additional 120-day extension to April 30,2015 to the SHIP FY 2011/2012 program funds to provide for additional time to expend all funds; this request was granted by FHFC on December 16,2014. FHFC does not require the Board Chairman to sign a document for the extension to take effect. FISCAL IMPACT: The proposed action described in this executive summary has no new fiscal impact.The funding source for the grant is the Florida Housing Finance Corporation. Funds are budgeted within SHIP Grant Fund 791,Project 33198, 33222, and 33258. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval.-JAB GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will further the Goals, Objectives, and Policies within the Housing Element of the Growth Management Plan. April 10, 2014 FHFC granted an extension to our SHIP FY 2011/2012 program funds to December 31, 2014 ($250,000 unspent). At that time Collier had embarked on the development of a SHIP rehabilitation program and we were anticipating expenditure of the extended funds by December 2014. We previously provided the agreement with our rehabilitation partner demonstrating the commitment of the funds. Collier County is happy to report our single family rehabilitation program is in full swing. We have the remaining SHIP FY 2011/2012 allocation committed as follows: • 13-applicants income qualified and approved for rehab assistance o 5-currently under contract and repairs being completed to home o 4-currently out to bid o 4-currently awaiting the initial inspection (3-very low income; 1-low income) $ 84,924 - SHIP funds currently under contract($27,269-very low; $57,655-low) $ 78,500 -Estimated bid amounts for projects out to bid ($63,500-very low; $15,000- low) $ 16,342 - Project delivery cost owed to subrecipient $ 70,234 - Estimated SHIP funds to be committed to the 4 new referrals awaiting inspection (and associated project delivery) $250,000 -Total funds for in-progress/qualified projects We had fully anticipated meeting the December extension date, and as is evidenced above, a great deal of effort has been made in attempt to reach that goal. Based on this evidence, we are respectfully requesting an additional 120-day extension to April 30, 2015. This will allow us to complete and expend the projects outlined above in a compliant manner. We would very much appreciate the opportunity to expend these funds, rather than have them revert. According to Rule 67-37, which governs the SHIP program, exceptions to the timeframe, are allowable under certain conditions, as detailed below: The funds deposited to the local housing assistance trust fund must be spent within twenty- four months from the end of the applicable State fiscal year. Exceptions to this time frame must be approved by a majority vote of the Review Committee on a case-by-case basis. Exceptions will only be granted for good cause. Examples of good cause are natural disasters, requirements of other State agencies, adverse market conditions, and unavoidable development delays. Adequate documentation must be presented to the Review Committee before an extension will be granted, e.g.,project status, work plan and completion schedule, commitment of funds, etc. Florida Housing believes that your current situation warrants an extension based on the reasons presented in your correspondence. Therefore, your deadline to expend funds for the 2011/2012 fiscal year is extended by an additional four (4) months. The new deadline is April 30, 2015. We do stipulate, however, as a part of this extension, when requested, the County provide the Corporation a written update outlining the status of the current spending. Please keep in mind that you are still required to submit an annual report on September 15, 2014.
