(Staff and County Attorney’s request - One of the candidates has withdrawn, so that we now have the same number of candidates as open seats. There is no need for an election. Staff will reschedule for a future Board meeting) Move Item 17A to Item 9A: Recommendation to adopt an ordinance making it unlawful to knowingly hire an unlicensed contractor. (Commissioner Solis’ request) Move Item 16K6 to Item 12B: Recommendation to appoint a member to the Affordable Housing Advisory Committee. (Commissioner Fiala’s request) Note: Correction Item 16F3 should read: Procurement staff and Tourism staff have reviewed the bid submissions and chosen Publication Printers Corporation based on price, references and experience of publishing similar guides. Therefore, staff recommends award of the printing 75,000 copies of the 2018 Visitor Guide to the lowest bidder in six all of the seven alternative quantities and bindings, Publication Printer Corporation, Denver CO. (Staff’s request) 01/23/2018 EXECUTIVE SUMMARY Request that the Board set the balloting date for the recommendation of members to the Pelican Bay Services Division Board by record title owners of property within Pelican Bay, and adopt the recommendations set forth in the Executive Summary as to the filling of these seats. OBJECTIVE: To set the balloting date for mail ballots for applicants seeking membership on the Pelican Bay Services Division Board. CONSIDERATIONS: This 11 member Board was established by Ordinance 2002-27 as amended. The Division provides landscaping services, including all public road maintenance and park areas, street lighting services, aquatic management services, beach cleaning, and the Clam Bay Restoration Project. It is the Division’s responsibility to provide the framework of long-term community planning so that residents can enjoy the benefits of Pelican Bay while ensuring both the social and financial well -being of the Pelican Bay Community. A list of the current membership is included in the backup. Mr. David Trecker’s (resident) term would have expired on March 31, 2019, but he resigned effective January 1st of this year. The terms for Gary Ventress (resident), Susan O’Brien (resident), and Peggy Pinterich (commercial/business) will expire on March 31, 2018. Swider Resident 2 Yes Susan O’Brien Resident 2 Yes Code of Laws Section 122-1662(c) states that the Board of County Commissioners shall publish the list of nominees and the positions on the Committee for which they have been nominated and deliver a conformed copy to the Clerk of Courts. The Clerk shall cause the name of each nominee as reported and published by the Board of County Commissioners to be included on the mail ballot, which ballot shall be mailed to all of the non-governmental property owners of the class (i.e. “Residential or Commercial/Business/Other”) corresponding with the class for which the balloting is occurring (“Residential or Commercial/Business/Other”) within the Unit no less than thirty (30) days prior to the balloting date. Said balloting date being set by the Board of County Commissioners. THE BALLOTING DATE RECOMMENDED BY THE CLERK IS: Monday, March 5, 2018 The Residential Vacancies There are 4 candidates for 3 open seats. Two of the seats have terms which will expire Ma rch 31, 2022. Mr. Trecker’s now open seat expires March 31, 2019. It is the recommendation of the County Attorney that the candidates with the two highest number of votes receive the seats which expire March 31, 2022, with the third-place candidate receiving the seat which expires March 31, 2019. The Commercial/Business Vacancy Since there is only one Commercial/Business vacancy, and Mr. Fabregas’s application was the only application received in that category, no balloting is required, and Mr. Fabregas’s application shall be 16.K.7 Packet Pg. 709 01/23/2018 forwarded to the Board of County Commissioners at a later time for consideration to be appointed. FISCAL IMPACT: Approximately $8,000 for ballot preparation, printing, postage and tabulation. (Sec. 122-1662(e), Collier County Code) GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the Board of County Commissioners sets the balloting date as: Monday, March 5, 2018, directs the County Attorney to prepare a resolution confirming the balloti ng date, and adopt the recommendations set forth above as to the filling of the open seats. The board will exercise decision and control of the day to day operational affairs of the Unit to the maximum extent allowed by law, unless and except when there is some overriding governmental reason to do otherwise. Membership shall be 9 representatives of the residential interests within the Unit and 2 representatives of the commercial & business interests within the Unit. Terms are 4 years.
