Agenda 01/23/2018 Item #16F601/23/2018 EXECUTIVE SUMMARY Recommendation to approve four Termination of Economic Development Impact Fee Payment Assistance Program Agreements and Release of Liens for companies that have met or exceeded their job-creation requirements. Three of the four terminations will be early. OBJECTIVE: To terminate agreements between the County and businesses that have active Fee Payment Assistance Program Agreements that have met or exceeded their job-creation requirements, but still require annual monitoring activities. CONSIDERATIONS: The Fee Payment Assistance Program was created by Ordinance No. 2003-61, Codified in Chapter 49 of the Code of Laws and Ordinances. The purpose of the program is to (1) provide a performance-based program offering financial relief for eligible targeted industry development or expansion projects in Collier County to mitigate the effects of rising impact fee rates; (2) provide for the economic wellbeing of Collier County residents by providing high-wage employment opportunities in Collier County; (3) lessen the seasonal cycle of Collier County's economy; and (4) encourage investment opportunities for new or existing companies, thus increasing and diversifying the county's tax base. Under the terms of these Fee Payment Assistance Program Agreements, the impact fees were paid by the County and the businesses created the requisite number of specified jobs. The County would then monitor the agreement for up to 15 years. The following businesses have an active agreement for fee-payment assistance: Arthrex, Inc. and Arthrex Manufacturing, Inc.; Anchor Health Centers, P.A. and Naples Investment Group, LLC; Guadalupe Center, Inc.; and Staffordshire Properties, Inc. Since the creation of the Office of Business & Economic Development in 2012, the Board has approved new economic development incentive programs with monitoring requirements averaging approximately five years. Given that most of these agreements have undergone 10 or more years of satisfactory annual monitoring, staff believes further monitoring activity is an unnecessary administrative burden on the recipient companies and the staff (County Manager and Clerk) and that these agreements should be terminated. FISCAL IMPACT: The termination of these agreements will not result in any incentive funds being paid to any of the companies listed. Incentive funds have already been paid. The recording of these agreements may incur a fee. Sufficient funds are available in the Economic Development budget (001- 138760) for the recording expense. GROWTH MANAGEMENT IMPACT: This request is consistent with Objective 3 of the Economic Element of the Collier County Growth Management Plan, which states: “Collier County will support programs that are designed to promote and encourage the recruitment of new industry, as well as the expansion and retention of existing industries to diversify the County’s economic base.” LEGAL CONSIDERATIONS: It is a policy decision as to whether the Board desires to terminate three of the four agreements early. is made and entered into as of July 11, 2017,by and between Staffordshire Properties, Inc., a Massachusetts domestic profit corporation, and Collier County, a political subdivision of the State of Florida("County"), collectively stated as the"Parties." WHEREAS, on February 7, 2006, the County entered into an Agreement for Fee Payment Assistance Program with Training and Manufacturing Institute, Inc., attached hereto as Exhibit A, and hereinafter referred to as"Agreement"; and WHEREAS, Staffordshire Properties, Inc. hereby represents to the County that it is the successor in interest to Training Manufacturing Institute,Inc., in relation to the Agreement; and WHEREAS, Staffordshire Properties, Inc. represents to the County that it is eligible to remain in the fee Payment Assistance Program(Immokalee)pursuant to criteria set forth in Ordinance No. 2003-61, as amended, which required the creation of a minimum of 5 new full-time jobs at an average wage of at least 50%of Collier County's then current private sector average wage($16,367); and WHEREAS,the parties wish to formalize Staffordshire Properties,Inc.'s assumption of rights and obligations under the Agreement, which is effective as of the date of closing on the subject property by Staffordshire Properties, Inc.,which is scheduled to occur on or about July 31,2017. NOW THEREFORE, IN CONSIDERATION of the mutual promises in this Assumption Agreement, and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged by the parties, it is agreed as follows; 1.
