EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney to retain James L. Nulman, Esq. of Nulman
Mediation Services as needed for general litigation cases involving Collier County.
OBJECTIVE: To approve an increase in hourly rate fees for mediation services of Jim Nulman to
enable the County to use Nulman Mediation Services to seek to resolve disputes through mediation.
CONSIDERATIONS: The County Attorney’s Office has on occasion retained Nulman Mediation
Services to conduct Court-Ordered Mediation as needed. In January 2018, Mr. Nulman’s hourly rate will
increase from $195 per hour with two (2) parties to $225 per hour with two (2) parties (Fee Schedule
attached as Exhibit A). The Collier County Circuit Court rules generally require parties to engage in
Court-Ordered Mediation. A significant amount of general litigation cases involving Collier County are
resolved through mediation conducted by skilled and experienced mediators. Mr. Nulman is an
experienced mediator that the County wishes to retain as needed. Mr. Nulman does not charge travel time
to hold mediations in Collier County.
The County Attorney’s Office requests the Board authorize the County Attorney to retain as needed
Nulman Mediation Services.
FISCAL IMPACT: Funds for these Nulman Mediation Services shall come from the individual
department’s budgets based on the nature of the litigation.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been prepared by the County Attorney’s Office, is
approved as to form and legality, and requires a majority vote for Board approval. - CMG
RECOMMENDATION: For the Board of County Commissioners to authorize the County Attorney to
retain James L. Nulman, Esq. of Nulman Mediation Services as needed for general litigati on cases
involving Collier County.
