EXECUTIVE SUMMARY
Recommendation to approve a Certification of Financial Responsibility, as required by the Florida
Department of Environmental Protection, for the renewal of an operating permit for the deep injection
well system at Collier County’s South County Water Reclamation Facility.
OBJECTIVE: To certify unconditionally to the Florida Department of Environmental Protection (FDEP)
the county’s obligation to perform plugging and abandonment of the deep injection well system at Collier
County’s South County Water Reclamation Facility (SCWRF) pursuant to Chapter 62-528 Florida
Administrative Code.
CONSIDERATIONS: The permit renewal application requires the county to complete and execute a
Certification of Financial Responsibility form. This form certifies that the county will be unconditionally
obligated to have the financial resources necessary to close, plug, and abandon the Class I injection well
and related monitoring wells.
The Certification of Financial Responsibility for the SCWRF Injection Well (IW) 2 renewal permit was
previously approved by the Board of County Commissioners on September 26, 2017, under agenda item
16C6. The certification covered IW-2 and the Dual Zone Monitor Well (DZMW) 1. The financial
certification was part of the renewal permit package for IW-2 submitted to FDEP on October 9, 2017.
A previous Certification of Financial Responsibility for the SCWRF was submitted in October 2014 with
the renewal application for IW-1. It covered both injection wells IW-1 and IW-2 and DZMW-1. The
estimate to plug and abandon the wells was $545,814. The current estimated cost to plug and abandon
IW-1, IW-2 and DZMW-1 is $753,135, which exceeds the 2014 cost. Since the current cost exceeds the
previous cost, the FDEP requires a new Certification of Financial Responsibility form.
FISCAL IMPACT: The actual expenditure of funds is not anticipated and would only be required if an
injection well was to be abandoned. Funds to cover these costs, if needed, are maintained in the Reserves
for Contingency line item in the Water/Sewer Fund (408), which is funded through user fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
executing this document.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - JAB
RECOMMENDATION: To approve and authorize the Chair to execute the Certification of Financial
Responsibility form.
