EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign a Collier County Landscape
Maintenance Agreement (“Agreement”) between Collier County and RaceTrac Petroleum, Inc., for
landscape improvements within the Immokalee Road Right-of-Way.

OBJECTIVE: To authorize the construction of landscaping improvements within the County right -of-
way and to ensure RaceTrac Petroleum, Inc. will maintain the improvements accordingly.
CONSIDERATIONS: County staff was approached by RaceTrac Petroleum, Inc. to install sod and
irrigation adjacent to the RaceTrac development within the Immokalee Road public right -of-way.
Pursuant to the attached Landscape Maintenance Agreement, RaceTrac Petroleum, Inc. agrees to
construct and maintain the sod and irrigation improvements. The request was reviewed by staff and the
area is not in conflict with any projects identified in the 5 year Capital Improvement Plan. The agreemen t
allows for the county to reclaim use of the property if it needs it the future. The plans were reviewed and
approved by the Road Maintenance Division's landscape architectural staff and are in compliance with
applicable standards. We encourage property owners to beautify the county right-of-way at no cost to the
county.
FISCAL IMPACT: There are no associated costs to the Board related to this Agreement. RaceTrac
Petroleum, Inc. is responsible for all recording fees, construction costs and maintenance thereafter.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval- SAS.
RECOMMENDATION: To sign a Collier County Landscape Maintenance Agreement between the
Collier County Board of Commissioners and RaceTrac Petroleum, Inc. for landscape and irrigation
improvements within the Immokalee Road right-of-way.
