Recommendation to approve Petition VAC-PL20170002642 to vacate a portion of the 25-foot drainage easement located on Lot 15, Nature Pointe, as recorded in Plat Book 20, Pages 20 through 22, of the public records of Collier County, Florida. The subject property is located on the west side of Gordon River Lane, on the east side of the Golden Gate Canal, in Section 35, Township 49 South, Range 25 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate a portion of the 25-foot drainage easement located on Lot 15, Nature Pointe, as recorded in Plat Book 20, Pages 20 through 22, of the public records of Collier County, Florida, also being a part of Section 35, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20170002642 has been received by the Development Review Division, Growth Management Department from Petitioner, Francesca Passidomo, Esq., of Coleman Yovanovich & Koester, P.A., as agent for the property owners, to vacate a portion of the 25-foot drainage easement located on Lot 15, Nature Pointe, as recorded in Plat Book 20, Pages 20 through 22, of the public records of Collier County, Florida, also being a part of Section 35, Township 49 South, Range 25 East, Collier County, Florida. According to the Property Appraiser’s website, Douglas S. Lee and Min Chung Kim are the fee simple owners of the subject property. The Petitioner is proposing to vacate the eastern 15 feet of a 25 -foot drainage easement (swale) located in the rear of the property, in order to construct a swimming pool within the vacated area. The drainage easement was dedicated to Collier County with no maintenance responsibility, and to the Nature Pointe Homeowners Association with maintenance responsibility, according to the Nature Pointe plat. The 15-foot wide portion of the drainage easement being vacated is not necessary for the proper functioning of the drainage easement. The property owners will modify the lot to accommodate the required water quality volume of the 25-foot rear yard swale within the remaining 10-foot rear yard swale. There is no public detriment resulting from the vacation of the drainage easement, because the vacation will not adversely affect the storm water and drainage management of the area, nor will it have an adverse impact on abutting properties. The Development Review Division has reviewed this petition and found no reason for objection. Letters of no objection from abutting property owners have been received from all who responded, as well as from the Nature Pointe Homeowner’s Association. FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. LEGAL CONSIDERATIONS: Pursuant to Resolution 2013-166 and Florida Statutes Section 177.101, the Board may adopt resolutions vacating plats in whole or in part of subdivisions in Collier County, 12/12/2017 returning the property covered by such plats either in whole or in part into acreage, when the following criteria are met: 1. The request is in the interest of the general public welfare, or no public detriment is established 2. The request does not invade or violate individual property rights 3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be vacated 4. The vacation will not affect the ownership or right of convenient access of persons owning other parts of the subdivision. This item has been approved as to form and legality and requires a majority vote for Board approval. (SAS) RECOMMENDATION: To approve the attached Resolution, relating to Petition VAC-PL20170002642, which will vacate the County and the Public interest in a portion of the 25-foot drainage easement located on Lot 15, Nature Pointe, as recorded in Plat Book 20, pages 20 through 22, of the public records of Collier County, Florida, also being a part of Section 35, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A; and direct the Clerk to the Board to record a certified copy of the Resolution in the public records and to make proper notation of this Resolution on the plat of Nature Pointe, as recorded in Plat Book 20, Pages 20 through 22 of the public records of Collier County, Florida.
