Agenda 12/12/2017 Item #17G12/12/2017 EXECUTIVE SUMMARY Recommendation to adopt a Resolution establishing the Cassena Road Potable Water Municipal Services Benefit Unit (MSBU) to provide Collier County potable water connections, authorize the use of the uniform method of collection for collecting non-ad valorem assessments to fund the MSBU, and approve an Interlocal Agreement with the Property Appraiser and Tax Collector to facilitate such collections. OBJECTIVE: To provide connections to Collier County potable water service for residences located on a portion of Cassena Road. CONSIDERATIONS: In April 2017, a residential property owner on Cassena Road inquired about establishing an MSTU/BU to connect households along the road to the County Potable Water System. Petitions for a Municipal Service Benefit Unit (MSBU) were prepared under the guidance of the County Attorney’s Office and circulated to all thirteen (13) property owners. Eight of the thirteen petitions (61%) were returned with signatures, indicating majority support for establishing a Cassena Road MSBU. Preliminary cost estimates for design, equipment, construction, County fees, and overhead (2017 dollars) were obtained. Upon consultation with the Public Utilities Department, a realistic cost for this project is estimated to be $229,858. The cost to install piping from the MSBU streetside connection to the on-site dwelling(s) shall be borne at each property owner’s sole expense independent of the MSBU process. The proposed Resolution will utilize the Equivalent Residential Connection (ERC) method for identifying the benefit to each property from its ability to connect to the 6" water main to be installed in the project and, in turn, computing the special assessment of each property. As such, the Proposed Resolution sets forth that each of the 13 parcels will be assigned 1 ERC at the outset, whether currently developed or vacant, resulting in an initial assessment of $17,585 for each parcel. The initial assessment is subject to change upon the final estimate prepared by the County Manager and approved on the Assessment Roll at a later date. Some of the affected property owners are not able to pay the full estimated $17,585 assessment up front, and a five-year collection process would push the construction phase out to 2024. Therefore, the property owners are requesting the Board consider a short-term five-year loan to the MSBU to facilitate construction during Fiscal Year 2018-2019. A 3% interest will be collected annually over those five years. In addition, the County will collect 1.5% against each assessment for the administration of the MSBU, as well as 3.5% to reimburse the County for retaining the services of the Property Appraiser and Tax Collector for the collection of the assessments. With this loan, improved water quality co uld be provided five years sooner, anticipated construction cost increases could be avoided, and up to thirteen additional County water customers will be added, including the associated impact fees. The proposed Resolution has been duly advertised and is now submitted to the Board for final adoption. To appropriately assessed the property owners for the project and loan, the Board must enter into an Interlocal Agreement with the Collier County Property Appraiser and Tax Collector to facilitate the collection of MSBU assessments. The Interlocal Agreement is also included with this item for the Board’s approval. FISCAL IMPACT: The cost to record the Resolution and Interlocal Agreement totals will be paid by the Improvement District operating account within the Unincorporated Area General Fund. The cost for this project will be fully funded in Fiscal Year 2018-2019 through a County loan from the Unincorporated Area General Fund with the MSBU reimbursing the County over five years. 12/12/2017 GROWTH MANAGEMENT IMPACT: This action will add 13 new customers to the Collier County potable water system. The impact to the system will be mitigated by the impact fees assessed to each property owner. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for Board approval. Please note that the MSBU is only paying for the cost of the project. After the water pipe in laid, the residences will ultimately need to connect to the new line. The current cost to connect to the system (the water impact fee) is $2,562 for the typical residential home; larger homes could potentially pay more (but that is rare). In addition the homeowners would need to pay the costs to install piping from their residence to the new water line. - JAK RECOMMENDATION: To adopt a Resolution establishing the Cassena Road Potable Water MSBU to provide Collier County potable water connections, authorize the use of the uniform method of collection for collecting non-ad valorem assessments to fund the MSBU, approve the Interlocal Agreement with the Property Appraiser and Tax Collector, and authorize the Chair to sign all applicable documents associated with these approvals. Subject: Cassena Road MSBU Assessment Methodology, ABB PN #17-0146 Cassena Road is located in the Pine Ridge subdivision in Collier County, located east of U.S. 41 just south of Vanderbilt Beach Road. The residents of this road have approached Collier County to form an MSBU to fund the design and construction of a potable water main to serve these existing home sites. The purpose of this memo is to provide our professional opinion of an equitable method of assessing each owner for the cost of this project. Several methods have been used to assess owners served by public municipal services projects. The methods would include proration based on lot area (LA), proration based on linear lot front footage (LFF), or equivalent residential connections (ERC). Each of these methodologies has merit based on the service being provided. Each method also involves different levels of complication which may or may not be necessary. Using the lot area methodology would involve calculation of each lot’s square footage or acreage based on the subdivision plat of record for the area. The total cost of the project would be distributed among the owners using a weighting factor based on the lot area. This methodology could take into account the variation in house sizes and potential utility impact potential since a larger lot could accommodate a larger home. The linear lot front footage methodology would be similar to the lot area method; however, the proration would be based on lot frontage as opposed to lot area. Corner lots would be unfairly assessed under this methodology. Most modern utility evaluation is based on the equivalent residential connection (ERC) concept. Treatment plant capacity, main extensions, and other related infrastructure are all sized using the ERC concept. Calculation of the ERC values can be complicated, as it is based on the number of fixtures in a home and in Collier County determines meter size. The ERC is the most definitive indicator of a user’s impact on the utility on a day to day basis. In the case of the Cassena project, the ERC values are a predictor of the connection fees paid at the time of hookup. Collier County standards require a minimum 6” potable water main based on ownership and maintenance requirements, thus the design of this system isn’t being driven by the water use of the MSBU participants. A 6” water main can serve the potable needs of many more units than are proposed to be served by this MSBU. Each participant will have equal access to the water supply, therefore the most equitable method of distributing the cost of this improvement is on a lot served basis, independent of lot size, front footage, or potential residential water use.
