EXECUTIVE SUMMARY
Recommendation to approve a $1,300,000 budget amendment to fund the Golden Gate City Water
Interconnects, Project Number 70220.
OBJECTIVE: Reallocate water projects funding within the Water User Fee Fund (412) to align with
critical priorities needed to maintain reliability, meet demand, and remain in compliance.
CONSIDERATIONS: The proposed scope of work for Project 70220, “Golden Gate City
Interconnects” was not included in the Capital Improvement Program (CIP) contained in the 2014 Water,
Wastewater, Irrigation Quality Water, and Bulk Potable Water Master Plan/CIP Plan. Subsequent to the
approval of the CIP, changing operational priorities dictate the need for this project to be constructed.
Funding for this project identified below. No encumbrance will result directly from the approval of this
item. All approvals and procurements with these funds will be made in accordance with the county’s
Procurement Ordinance.
On November 14, 2017 as Agenda Item 9B, the Board of County Co mmissioners approved a Resolution
declaring the acquisition of the assets of the Florida Governmental Utility Authority serving the Golden
Gate City community in Collier County, Florida, by the Collier County Water-Sewer District.
The Golden Gate City Interconnect project consists of three separate water main interconnects between
the Collier County Water-Sewer District (CCWSD) water system and the Golden Gate City utility
(“Utility”) owned and operated by the Florida Governmental Utility Authority (FGUA). Interconnect No.
1 is located at the intersection of Collier Boulevard and Green Boulevard. Interconnect No. 2 is located
on Santa Barbara Boulevard between Recreation Lane and 55th Terrace Southwest. Interconnect No. 3 is
located on Tropicana Boulevard from 31st Place Southwest to Magnolia Pond Drive (Golden Gate High
School). Interconnect construction will commence prior to the CCWSD’s acquisition of the utility with
plans to reach 95% completion. Because Interconnect No. 3 is partially located on Golden Gate High
School property it is critical that its construction start in advance of closing to facilitate work at the school
during the 2018 spring break. Otherwise, construction would need to be done in the summer, delaying
the project. Once the Utility transaction is closed, the final three connections will be made to the newly
acquired assets. These interconnections will allow the CCWSD regional system to supply water to
Golden Gate City instead of operating the existing Utility water plant. Due to the proximity of the South
County Regional Water Treatment Plant, it is operationally more cost -advantageous to supply from the
regional system due to economies of scale. Water quality will also be consistent throughout the regional
system.
Florida law and the CCWSD/FGUA interlocal agreement ("FGUA Interlocal") provide CCWSD authority
to acquire the system at any time, subject to appropriate public interest determination by the Board of
County Commissioners. The Board of County Commissioners has issued a resolution finding the
acquisition in the public interest and the transition agreement has been signed by the County and FGUA.
There is no authority stated in Florida law, the FGUA Interlocal agreement, nor the transition agreement
which would permit FGUA to terminate the acquisition, so long as the County completes the steps
necessary to pay off or assume the outstanding FGUA bonds and other liabilities. For this reason, there is
no termination provision or other term in the transition agreement which would allow FGUA to refuse to
go forward with the sale if the County is prepared to close. Rather, section 5.02 of the transition
agreement makes clear that the agreement does not terminate until FGUA conveys the Golden Gate
System to CCWSD. These facts considerably limit the County's risk of the acquisition not closing as the
County remains solely in control of the process toward closing from this point forward.

The budget amendment will include all costs associated with the construction of the three water main
interconnects along with the construction administration and construction engineering and inspection
services.
FISCAL IMPACT: The source of funding is the Water User Fee Fund (412). A budget amendment is
required to move $1,100,000 from Water Reserves, and $200,000 from Project No. 70178 (Tree Farm
Road Loop) to Project No. 70220 (Golden Gate City Interconnects). Staff analyzed current and future
needs to be funded from the cited projects to assure that the budget amendment will not affect current and
future financial commitments.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
RECOMMENDATION: To authorize the necessary budget amendment to transfer $1,100,000 from
Water Reserves and $200,000 from Project No. 70178 to Project No. 70220 to fund the Golden Gate City
Interconnects Project.
