(Commissioner McDaniel’s request) Move Item 16C5 to Item 11M: Recommendation to approve payment in the amount of $344,862 to Ashbritt Environmental for food services procured as a result of Hurricane Irma. 12/12/2017 EXECUTIVE SUMMARY Recommendation to authorize the publication of Collier County’s notice of intent to utilize the uniform method of collecting non-ad valorem assessments in unincorporated Collier County in accordance with F.S. 197.3632(3)(a), in consideration and as part of the Stormwater Utility Phase II process. OBJECTIVE: To obtain authorization to publish notice of intent to utilize the uniform method of collecting non-ad valorem assessments to fund stormwater management projects. CONSIDERATIONS: On November 18, 2014, the Board of County Commissioners (Board) approved Collier County Planning Commission’s recommendation to seek an alternate source of funding to adequately fund Stormwater Management related initiatives and operations (Item 9.A). On November 3, 2015, the Board of County Commissioners discussed initiating an analysis of development of a stormwater utility during the Integrated Water Resources Management Strategy Workshop. The purpose of a stormwater utility feasibility study is to take a detailed look at all current and future stormwater and surface water management needs and evaluate a mechanism that would create a dedicated restricted funding source that would support the stormwater program. On December 8, 2015, at a regular Board of County Commissioners meeting, the Board authorized staff to secure a consultant and begin Phase I of the stormwater utility review and analysis (Item 16.A.20). A notice to proceed was issued on April 19, 2016, for consultant Amec Foster Wheeler Environmen t & Infrastructure, Inc. to complete the Phase I portion of the project. On September 27, 2016, staff along with Amec Foster Wheeler Environment & Infrastructure, Inc. provided the Board of County Commissioners with an overview of a stormwater utility (It em 11.C). The Board directed the County Manager to proceed with a stormwater utility feasibility study, Phase II, that would evaluate an alternative dedicated funding source for ongoing and future Stormwater Management related initiatives and operations; and to bring the findings of the study back to the Board for future consideration on implementation. On June 27, 2017, the Board of County Commissioners directed the County Manager to proceed with Phase II of the analysis to develop and provide the necessary study and materials required to properly make major policy decisions regarding rate structure, billing methodology, levels of service, and rate study methodology for implementing a stormwater utility for Collier County. A notice to proceed was issued on July 17, 2017 for consultant Stantec Consulting Services, Inc. to complete the Phase II portion of the project. On October 10, 2017, Stantec Consulting Services, Inc., along with county staff, presented an update presentation on the stormwater utility phase II rate study. Board of County Commissioners directed the County Manager to continue forward with the Phase II analysis (Item 11.B). Florida Statute Section 197.3632(3)(a) requires the Board to adopt at a public hearing a Resolution declaring the County’s intent to use the uniform method of collection for non-ad valorem assessments and that notice of intent is to be published weekly for 4 consecutive weeks prior to a public hearing. This item is asking for authorization to publish that intent. This it em will not bind or obligate the county in any way, rather this item will allow the county to utilize the uniform method of collecting, if it is determined by the Board of County Commissioners, to move forward with a stormwater utility fee. A notice of intent includes the preliminary estimated range for an Equivalent Residential Unit (ERU) of up to a maximum of $130 per year. The Notice of Intent to be published sets a public hearing for February 13, 2018 for the adoption of a 12/12/2017 Resolution setting forth the County’s intent to use the uniform method of collection for non-ad valorem assessments to fund stormwater improvements. At this public hearing, the staff will also: Provide a full and complete rate study, identifying benefits and challenges in more detail, including the basis for an Equivalent Residential Unit (ERU), potential credits and considerations. Share with the Board the information gathered through the Public Engagement Program. Provide a menu of options that allow the Board to set a specific Level of Service with a fee structure that is equitable and fair. FISCAL IMPACT: There is no anticipated fiscal impact to the County as a result of this item. Potential fiscal impacts will be presented in a subsequent meeting in February 2018. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for approval. - ERP GROWTH MANAGEMENT IMPACT: This item is in accordance with the goals, objectives, and policies of all applicable sections of the Stormwater Management and the Conservation and Coastal Management elements of the Growth Management Plan. The County will consider the adoption of a resolution electing to use the uniform method of collecting such assessments authorized by section 197.3632, Florida Statutes, at a public hearing to be held at 9 a.m. on February 13, 2018 in Board of County Commissioners Chambers, Third Floor, Collier County Government Center, 3299 Tamiami Trail E, Naples, Florida 34112. Such resolution will state the need for the levy and will contain a legal description of the boundaries of the real property subject to the levy. Preliminary estimated range for an Equivalent Residential Unit (ERU) will be up to a maximum of $130 per year. Copies of the proposed form of resolution, which contains the description of the real property subject to the levy, may be obtained from the Clerk to the Board of County Commissioners at the Board Minutes and Records Department. All interested persons are invited to attend. In the event any person decides to appeal any decision by the County with respect to any matter relating to the consideration of the resolution at the above -referenced public hearing, a record of the proceeding may be needed and in su ch an event, such person may need to ensure that a verbatim record of the public hearing is made, which record includes the testimony and evidence on which the appeal is to be based.
