Agenda 12/12/2017 Item #16A2812/12/2017 EXECUTIVE SUMMARY Recommendation to terminate for convenience Contract No. 16-6643, with Neal’s Lawn and Landscaping Maintenance, Inc., for nuisance abatement services. OBJECTIVE: To obtain Board of County Commissioners (Board) approval to terminate for convenience Contract No. 16-6643, with Neal’s Lawn and Landscaping Maintenance, Inc., for nuisance abatement services. CONSIDERATIONS: Collier County Ordinance Sec. 54-187(a), authorizes Code Enforcement staff to utilize the services of a mowing contractor to abate ongoing or unaddressed violations pertaining to overgrown lots and to also administer a mandatory lot mowing program for repeat violators. Neal’s Lawn and Landscaping Maintenance, Inc. was awarded the contract to perform these mowing services at the Board’s October 11, 2016, meeting. During the course of the past year, there have been numerous occasions wherein the vendor has been unresponsive to staff requests for mowing services at specific locations and has failed to perform mowing services in a timely manner. The vendor has since closed his business and moved to a new State. As such, staff believes it is in the best interest of the County to terminate the contract for convenience. Section eight (8) of the contract provides that the Co unty may terminate the contract for convenience at any time upon providing thirty (30) days written notice to the vendor. If approved, the termination of the contract will be effective at the close of business on January 11, 2018. During the interim, Code Enforcement staff will continue to work with Procurement Services staff, for the procurement of a new vendor to ensure that nuisance abatement services remain uninterrupted. FISCAL IMPACT: There is no fiscal impact from this action and any future nuisance abatement services will continue to be within the Board’s approved, operating budget. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires a majority vote for approval. - KLN GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
