Wherever used herein, the terms "Grantor" and "Grantee" include all parties to this instrument and their respective heirs, legal representatives, successors and assigns. Grantor and Grantee are used for singular or plural, as the context requires. WITNESSETH: Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, a perpetual, non-exclusive easement for access, improvement and maintenance upon and across the following described lands located in Collier County, Florida, to wit: See attached Exhibit "A"which is incorporated herein by reference; subject to easements, restrictions, and reservations of record. The purpose of this Easement is to allow Grantee the right to improve and maintain the Easement Area in such a manner as reasonably necessary to facilitate Grantee's travel from the paved areas of Grantor's contiguous property to Grantee's utility facilities located east of the Easement Area and beyond Grantor's property. Accordingly: Grantee shall have the right to make any improvements to the Easement Area that are reasonably and minimally necessary to affect the above stated purpose. Any such improvements by Grantee must first be approved in writing by the Grantor, which approval shall not be unreasonably withheld or delayed. There shall be no storage of equipment or material upon the Easement Area. Grantee shall undertake whatever continuing maintenance is reasonably and minimally necessary to prevent the Easement Area from Becoming an eyesore or nuisance. THIS PROPERTY IS NOT HOMESTEAD OF GRANTOR. TO HAVE AND TO HOLD the same unto the Grantee, together with the right to enter upon and across • said land for the purpose of vehicular and pedestrian access. Grantee shall have the right to improve and maintain the easement area as required for uninterrupted vehicular and pedestrian access. The easement granted herein shall constitute an easement running with the land and shall burden the lands described above.
