TERMINATION OF TEMPORARY
DRAINAGE EASEMENTS
This Termination of Temporary Drainage Easements (this "Termination") is given and made
effective as of thei"1#hday ofS.k� ,bc
,, r, 2017, by COLLIER COUNTY, FLORIDA, a political
subdivision of the State of Florida`(hereinafter referred to as the"County").
RECITALS:
WHEREAS, pursuant to that certain Amended Developer Agreement Orange Blossom Ranch
recorded in Book 4484, Page 1369 (the "Amended Developer Agreement"), a temporary drainage
easement was granted to the County in order to expand, utilize and maintain an existing drainage canal,
and a temporary drainage easement was granted to construct and maintain a drainage canal, until such
time as the water management system, as described in the original developer agreement, was fully
constructed and operational on platted land; and
WHEREAS, the easements granted to the County under the Amended Developer Agreement
were further documented by the Temporary Drainage Easement recorded in Book 4522, Page 2332, and
the Temporary Drainage Easement recorded in Book 4522, Page 3119, each in the Public Records of
Collier County, Florida(collectively,the"Temporary Easements"); and
WHEREAS, the purpose of the Temporary Easements has been served, and the obligations set
forth in the Amended Developer Agreement and Temporary Easements have been satisfied; and
WHEREAS, pursuant to the terms of the Amended Developer Agreement and the terms of the
Temporary Easements, the County is now required to acknowledge the expiration of the easements
granted under the Amended Developer Agreement and the Temporary Easements, and to terminate its
easement rights under the Amended Developer Agreement and the Temporary Easements, as they appear
of record.
NOW, THEREFORE, in consideration of the terms provided in the Amended Developer
Agreement and the Temporary Easements, together with other good and valuable consideration, the
receipt and sufficiency of which are hereby acknowledged, the County hereby confirms the recitals above
are accurate and incorporated herein, it acknowledges the easements granted under the Amended
Developer Agreement and the Temporary Easements as expired, it permanently and unconditionally
terminates the easements granted by the Amended Developer Agreement and Temporary Easements, and
it fully releases all right,title and interest, equitable or otherwise, that it they may have, or ever may have
had, in and to the real property pursuant to the Amended Developer Agreement and Temporary
Easements.
