EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement (Agreement) for Lot 7, Ashley Grove,
according to the plat thereof as recorded at Plat Book 32, Pages 26 through 27 of the public records
of Collier County.
OBJECTIVE: To approve an Easement Use Agreement between the County, the current property
owner of Lot 6, Ashley Grove and the Ashley Grove Homeowner’s Association, Inc.
CONSIDERATIONS: The property is located at 5113 Kensington High Street. The East side of the
house on the subject property encroaches 3.5 inches into a 7.5-foot Drainage Easement. The current
owner purchased the property with the encroachment in place. The subject easement is dedicated to
Collier County with no responsibility for maintenance and to Ashley Grove Homeowner’s Association,
Inc. with responsibility for maintenance, according to the Ashley Grove plat. The Homeowner’s
Association has provided a letter of no objection to the encroachment and stated that there remains
sufficient area to maintain the easement. There are no drainage facilities within the easement and the
Homeowner’s Association has joined in as a party to the Agreement. Development Review has reviewed
the Agreement and Exhibits and recommend approval of the Easement Use Agreement. The owner has
also applied for an Administrative Variance for the setback encroachment, which will be addressed
separately.
FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the
recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. SAS
RECOMMENDATIONS: To approve the Easement Use Agreement between the County, current
property owner of Lot 7 of Ashley Grove, and the Ashley Grove Homeowner’s Association, and
authorize the Chairman to execute the Agreement. To direct the Clerk to record the Easement Use
Agreement.
