Agenda 11/14/2017 Item #11D11/14/2017 EXECUTIVE SUMMARY Recommendation to accept the latest terms negotiated by the Naples City Manager and County Manager for a renewal of the Interlocal Agreement governing reciprocal use of City and County beach parking facilities and park and recreation programs. OBJECTIVE: To reach an agreement between the County and the City of Naples for a successor Interlocal Agreement governing reciprocal use of City and County beach parking facilities and park and recreation programs. CONSIDERATIONS: On March 7, 2017, the City and County held a joint workshop that discussed, among other topics, public beach parking supply, access and utilization patterns throughout the County. The Board and the City Council directed their respective managers to work on a successor Interlocal Agreement and report back on progress. The City Manager and County Manager have exchanged multiple proposals over the past several months in a good faith effort to arrive at a mutually agreeable position. At the October 24, 2017 Board meeting, an update was provided on the status of negotiations for a new Interlocal Agreement. Following the update on negotiations, the Board recommended approving the last proposal made to the City from the County Manager, and asked that the City favorably consider the proposal. The proposal offered the following terms: Collier County to provide $1,250,000 annually to the City. Free parking permitted at all Naples public beach parking spaces. Applicable to the residents of the City and unincorporated Collier County. No sale or distribution of non-resident beach passes, effective immediately upon formal acceptance of this proposal. Applicable to the City and Collier County. Continue to make Parks & Recreation Programs available to unincorporated area residents on the same terms and conditions as City of Naples residents. New interlocal agreement to replace the existing agreement for a term of five years. In subsequent discussions following the October 24 Board meeting, the City Manager indicated to the County Manager that he would be recommending approval of this agreement to the Naples City Council. The City Manager asked that a change be made to the new agreement for a term of three years rather than five, and that sale of nonresident beach passes be suspended immediately in anticipation of the City’s approval of the County’s offer. The County Manager responded favorably to these requests and Collier County Parks & Recreation suspended sale of the nonresident beach pass on October, 26, 2017. However, at the November 1, 2017 Naples City Council meeting, Council Members rejected the City Manager’s recommendation, and instead asked for the following terms in the agreement: Collier County to provide $1,500,000 annually to the City, effective January 1, 2018. Free parking permitted at all Naples public beach parking spaces. Applicable to the residents of the City and unincorporated Collier County. No sale or distribution of non-resident beach passes, effective immediately upon formal acceptance of this proposal. Applicable to the City and Collier County. 11/14/2017 Continue to make Parks & Recreation Programs available to unincorporated area residents on the same terms and conditions as City of Naples residents. New interlocal agreement to replace the existing agreement for a term of two years starting immediately. Naples City Council members also suggested that the City be responsible for all distribution of beach parking stickers at Naples City Hall. County staff finds this suggestion neither reasonable nor feasible. Staff also continues to hold the opinion that a longer agreement would create stability for residents participating in the beach sticker program, and allow time for data collection to evaluate any impacts from changes to the existing Interlocal Agreement that runs through September 30, 2018. After the City Council meeting, the City Manager and County Manager further discussed options and agreed to present the following to our respective governing bodies: Amend the current Interlocal Agreement to add four years to the term (Expiration on September 30, 2022). Collier County to provide $1,500,000 annually to the City with no annual index beginning October 1, 2018. Free parking permitted at all Naples public beach parking spaces with valid County beach parking pass applicable to the residents of the City and unincorporated Collier County. Discontinue sale or distribution of non-resident beach parking passes, applicable to the City and County, immediately upon acceptance of the agreement. Continue to make City Parks & Recreation Programs available to unincorporated area residents on the same terms and conditions as City of Naples residents. FISCAL IMPACT: If ratified, under the terms of the Interlocal Agreement, the County would remit an annual payment of $1,500,000 to the City of Naples starting in Fiscal Year 2019. Funding for Fiscal Year 2018 would continue to be governed under the existing Interlocal Agreement. Funding for the payment is appropriated in the annual budget. GROWTH MANAGEMENT IMPACT: There is no growth management impact. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issue, and requires majority vote for approval. -JAK RECOMMENDATION: To accept the terms negotiated by the County Manager and City Manager outlined above and bring back the final agreement to the Board for adoption.
