EXECUTIVE SUMMARY
Recommendation to approve an Agreement to Reinstate, Amend and Extend Contract No. 15-6530
- Architectural Services, to Disney & Associates on the Immokalee Fitness Center, to allow final
payment for professional services completed on the project.
OBJECTIVE: To extend contract #15-6530 that administratively expired on June 11, 2017 to coincide
with the construction contract close-out and allow Disney & Associates to be paid for their final invoice
for services completed under the purchase order.
CONSIDERATIONS: The Board of County Commissioners (BCC) approved Contract #15-6530 to
Disney & Associates, PA, (“Disney”) for architectural design services for the Renovation/Expansion of
the Immokalee Sports Complex Fitness Center. The original design contract was modified by Change
Order #1 to extend the anticipated project construction completion date to June 11, 2017, due to Grant
funding approval delays. The construction contract (#16-7029) Notice To Proceed (NTP) was issued on
February 27, 2017, which established August 26, 2017 as the final completion date. To achieve the full
contract close-out, the architect of record must be available to review the certification of completion to
cover the period from June 11, 2017 through the final construction completion date of August 26, 2017.
The construction contractor for contract (#16-7029) completed the major portion of the work by the
construction substantial completion date of July 25, 2017. The County has provided the Contractor a
punch list produced by Disney listing a few incomplete or unsatisfactory items that will be completed
quickly for final substantial completion and contract close-out.
Staff recommends approval of the attached Agreement to Reinstate, Amend and Extend Contract N o. 15-
6530 - Architectural Services through August 26, 2017 (to coincide with the construction close -out date)
to Disney & Associates on the Immokalee Fitness Center, to allow final payment for professional services
completed on the project. This contract was inadvertently allowed to administratively expire during the
final working days of the now retired County’s project manager.
FISCAL IMPACT: There is no fiscal impact.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan from this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority
vote for Board approval. -SRT
RECOMMENDATION: That the Board of County Commissioners approve the attached Agreement to
Reinstate, Amend and Extend Contract No. 15-6530 - Architectural Services (through August 26, 2017 to
coincide with the construction close-out date), to Disney & Associates on the Immokalee Fitness Center,
to allow final payment for professional services completed on the project.
