Recommendation to approve Petition VAC-PL20170001877 to disclaim, renounce and vacate the conservation easement described in O.R. Book 5079, Page 1855 of the Public Records of Collier County, Florida. The subject property is located on the north side of Elsa Street, approximately one quarter mile east of Shirley Street, in Section 11, Township 49 South, Range 25 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and public interest in the conservation easement described in O.R. Book 5079, Page 1855 of the Public Records of Collier County, F lorida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20170001877 has been received by the Development Review Division, Growth Management Department, from Andrew Rath, P.E. of Davidson Engineering, Inc., on behalf of the property owner, Aggregate Specialties, Inc., to vacate the conservation easement described in O.R. Book 5079, Page 1855 of the Public Records of Collier County, Florida as further described in Exhibit A to the attached Resolution. The applicant is proposing to vacate a 0.37 acre conservation easement on a 3.74 acre property zoned Industrial. The conservation easement was originally granted to the County in 2014 as a requirement of SDP AR-14304. According to the Collier County Property Appraiser, Aggregate Specialties, Inc. is the owner of the real property underlying the subject conservation easement. The property is developed with a refuse system facility that was approved as a Conditional Use via Resolution 2008-373 (Conditional Use 2007-AR-12619), and the preserve was a development condition of the Conditional Use approval. However, an LDC amendment in 2014 (Ord. 14 -33) removed the requirement for a preserve on Industrial-zoned parcels which have a preserve requirement of 2 acres of less (Section 3.05.07 B.2.h, LDC). Subsequent to that amendment, the Hearing Examiner approved HEX Decision 2017-05, which removed the preserve requirement from the Development Conditions of the Conditional Use for this property because a preserve was no longer required in accordance with the current LDC. As such, since the preserve is no longer required on this property, the property owner is requesting the vacation of the existing conservation easement. Therefore, the proposed vacation will not result in a public detriment. The petitioner has provided a letter of no objection from the abutting property owners. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: The Growth Management Department, Development Review Division staff has collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary. LEGAL CONSIDERATIONS: Petitioner is requesting the vacation of the conservation easement described in O.R. Book 5079, Page 1855 in the Public Records of Collier County, Florida. Pursuant to Resolution 2013-166 and Florida Statutes Sections 125.01 and 125.37, the Board may adopt 10/10/2017 resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof, granted to the County or public by any instrument recorded in the public records of Collier County and to renounce and disclaim any right of the County and the public in and to any land in connection therewith; when such interest is granted to the County or public by any instrument recorded in the public records other than on a subdivision plat, when the following criteria are met: 1) Public benefit is established or no public detriment is established Moreover, this request to vacate a conservation easement is consistent with the County’s vacation procedures under Resolution 2013-166, and Section 704.06(4), Florida Statutes, which states that “A conservation easement may be released by the holder of the easement to the holder of the fee even though the holder of the fee may not be a governmental body or a charitable corporation or trust.” This item has been approved as to form and legality and requires a majority vote for Board approval. - SAS RECOMMENDATION: To approve the attached Resolution, relating to Petition VAC-PL20170001877, which will vacate the conservation easement described in O.R. Book 5079, Page 1855 of the Public Records of Collier County, Florida, located in Section 11, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A; and direct the Clerk to the Board to record a certified copy of the Resolution in the Public Records of Collier County, Florida. To minimize the effect of noise and windborne dust on the commercial business to the south, the truck loading area shall be located in the northeastern quadrant of the site. 5. Sprinklers shall sufficiently water working areas of the site at least twice daily to effectively control windborne dust. Additionally, water shall be applied to the crushed by-product material at all times that the crusher is in operation. 6. The maximum height of material piles shall be limited to 40 feet. 7. To screen views of the piles and to help prevent dust from traveling off-site, a Type B buffer shall be provided along the site's southern and southwestern boundariesy at the interface of abutting uses. A five-foot wide Type A landscape buffer with an eight-foot high wall or an eight-foot high wall with berm combination shall be provided along the site’s southern boundary at the interface of abutting uses. Where this buffer overlaps the .37 acre preserve, Type B minimum plantings shall be maintained at all times within the buffer area. The balance of the create preserve shall consist of approved native mid-story and canopy species to achieve the desired buffering for properties to the south. 8. The first 150 feet of the site's entrance drive shall be paved as part of the first development order. This entrance shall also have a gate, which shall be locked outside of business hours.
