OBJECTIVE: To direct the County Manager to deny the request for refunds for the permitting fees paid by two wildlands fire victims, totaling $4,772.27, from the General Fund. CONSIDERATIONS: During the Board of County Commissioners (Board) meeting on September 26, 2017, agenda item 6A under the public petition, the Board directed the County Manager to bring back an agenda item for consideration regarding the refund of permitting fees paid by two wildlands fire victims. The properties involved in the public petition are as follows: Laurence and Peggy Le Buff 5000 Le Buff Road, Naples, FL 34106 Square Footage: (Existing Home) 971 sq. ft. Square Footage: (Replacement Home) 1,718 sq. ft. Permit Number: PRBD20170729575 Total permitting fees paid $2,395.42 Jim Kurth 4895 Le Buff Road, Naples, FL 34106 Square Footage: (Existing Home) 1,902 sq. ft. Square Footage: (Replacement Home) 2,619 sq. ft. Permit Number: PRBD20170729583 Total permitting fees paid $2,376.85 The subject properties are included in the attached Office of Agricultural Law Enforcement Case Mast er Report 17-912, which includes property descriptions and comments on fire damage. The report confirms that the above listed properties, along with various out buildings, a boat and trailer and small vehicles (all- terrain vehicle, golf cart and 2 wheeled trailers) were completely consumed by the wildlands fire. Staff is unaware of insurance coverages or claims for either of the properties. Fees collected for building and development permits are utilized to fund the full cost of operation for the majority of the Growth Management Department, Development Services element. Fees collected for permitting and inspection services performed are considered to be non-refundable. A decision to approve this request would set precedence for future refund requests, which could include large projects, such as the YMCA project which incurred major fire damage and the permitting fees totaling $182,991.99. Future approvals of this nature could result in significant costs to the taxpayers of Collier County. FISCAL IMPACT: The fiscal impact consists of permitting fees, totaling $4,772.27, which will be refunded from the General Fund. However, the precedence of this request may have potentially large fiscal repercussions for the County’s General Fund. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. The Florida Forest Service assigned incident number 2017-17-0088 and named it Lee Williams Road (11). A review of the weather conditions reported by the Florida Forest Service revealed that on March 5, 2017, the winds at the Caloosahatchee Forestry Office were from the ENE at 18mph, the temperature was 77 degrees Fahrenheit with a relative humidity of 38%. Fire Readiness was at a Level 2. The acreage of the fire at initial contact by FFS was 33 acres. Wind conditions and dry fuels quickly increased the size to several hundred acres. On 03/12/2017, the total acreage of the fire was 7,230 acres. Investigation On 03/07/2017, I arrived at the scene. An incident command center had been established at 8075 Lely Cultural Parkway, Naples, Florida. I contacted the Florida Forest Service to inform them of my presence and to advise that I would be the primary Investigator on the case. I was briefed on the incident by FFS Park Ranger, William Muirhead. I followed Ranger Muirhed to the suspected origin area, located at 5700 Lee Williams Rd., Naples, FL 34117. I then exited my vehicle and began my investigation by walking the perimeter of the possible origin area. Fire indicators and weather conditions revealed that the fire moved in a west-southwest direction. An examination of charring, protection and foliage freeze in the burned area led to the possible area of origin of the fire appearing to be located on the property. The head fire moved west from this location, jumped Lee Williams Road, and continued moving west. The fire burned down a barbed wire fence on the property as it moved west and crossed a chain-link fence to the south. Strong winds at the time of the fire aided in the fire moving and spreading quickly. Charring was evident on most of the trees up to at least 20 ft. or more, indicating that the fire grew in strength from the area of origin. No ignition sources, accelerants, or evidence of arson was located at the scene. There was no lightning reported in the area on the date of the fire and the fire was not near a railway. A power pole was located just outside the burned area, but it was not damaged. The evident charring and protection on the palm and pine trees in the area, foliage freeze and evident backing fire indicate that area of origin is in the northeastern area of the burned area on the property. On 03/08/2017, Lts. Hochuli and Raulerson met me at the fire scene and conducted an origin and cause investigation. Their findings were also consistent with my original findings which is a probable origin area on the northeastern side of the property located at 5700 Lee Williams Road. A search of the area of origin area was again conducted, but no ignition sources could be located. On 03/10/2017, FFS Rangers Fischer, Garcia and Nicoletti accompanied Lt. Hochuli and I to the area of origin. They were the first rangers to respond to the fire. Ranger Garcia stated that the area to the south of the area of origin was already burned when he arrived on scene, however, the property at 5700 Lee Williams Rd. was fully involved. The Rangers further advised the same south area on the property in question had burned about a year prior and may not have had much fuel, making it burn more quickly. Ranger Garcia began his suppression efforts by cutting a line around the burning area which included the property at 5700 and to the south of the property. He then began cutting a line from Lee Williams Rd. to the west beginning just north of the 5700 Lee Williams Rd. property gate. The rangers stated that fire was burning at a high rate when they arrived and had already crossed Lee Williams Rd. to the west and was moving at a high rate of speed. Interviews and Damage Assessment On 03/07/2017, Inv. Feiner interviewed Wayne Wood.,residing at 985 Snake Rd.Naples, FL 34117, Tel (239) 455-7462 relative to the wildfire damage he sustained. Mr. Wood stated that his hot tub and barbeque grill was completely lost due to the fire. He was not home at the time of the fire. Inv. Feiner interviewed Luis G. Valdes Jr.,via telephone, Tel (786) 366-0717, relative to the wildfire damage he sustained on his property located at 1015 Snake Rd.Naples, FL34117. Mr. Valdez stated that his trailer was completely lost due to the fire. He also advised that the trailer is empty and no one resides inside of it. He was not home at the time of the fire. Inv. Feiner walked the property obtained and observed the following: 1. Empty (Mobile) on the property destroyed, estimated damage $5,000.00. On 03/08/1017, Inv. Feiner interviewed Don Cure, residing at 1501 Snake Rd., Naples, FL 34117, Tel (239) 404-2518 relative to the wildfire damage he sustained. Cure stated that he called 911 Emergency Dispatch to report the fire. On 03/05/2017. He did not see anyone in the area and did not know how the fire started. He sustained no property damage. On 03/10/1017, Inv. Feiner interviewed Wes Welkins residing at 5721 Lee Williams Road, Naples, FL 34117, Tel (786) 366-0717 relative to the wildfire damage he sustained. Mr. Welkins stated he sustained no property damage due to the fire. Welkins stated that he had trouble with his neighbor Don Cure in the past and is suspicious Cure started the fire. Welkins did admit however that he has no evidence. On 03/14/1017, Inv. Feiner contacted Hugh House, the property owner of 5700 Lee Williams Road, Naples, FL 34117, Tel (239) 253-3223 relative to the wildfire damage he sustained. Mr. House stated he was not interested in continuing the conversation because he was not interested at all. An inspection of the property showed approximately 50yds of barbed wire fence and poles destroyed. Damage estimated at $1,000.00. On 3/9/2017, Investigators Hopkins and Kohler were assigned to conduct damage assessments and scene documentation of additional damage incurred by the wild fire. For further details regarding their damage assessments, see attached supplemental reports Conclusions No ignition sources were found in or around the area of origin of the fire. There was no lightning reported in the area on 03/05/2017, and the area of origin is not near any railroad tracks. There is one powerline pole next to the burned area, but it was undamaged. No witnesses to the fire starting have been located and no persons were observed in the area on the date of the fire. However, human causes cannot be ruled out. High winds, dry conditions and plentiful fuel caused the fire to burn quickly and move rapidly from east to west-southwest and jump several lines established by the FFS. An investigation of the fire scene, burn indicators and weather conditions conclude that the area of origin of the fire is most likely located on the northeastern side near the driveway and gate area located at 5700 Lee Williams Rd., Naples, FL 34117, map coordinates Lat 26’ 7’ 47”, Lon 81; 34; 51”. This is a vacant lot owned by Hugh House. The cause of this fire is undetermined. Case Closed. Kohler Narrative Wildland fire in Collier County, FL. I was assigned this incident by Lt. Hochuli at 9:00am on 3-9-2017. Upon arrival at the Collier County EOC at 10:00am of the same date, I was met by a representative of Forestry and advised that the burned dwellings were located on LeBuff Road. I responded to LeBuff Road and located the first burned up house at 4980 LeBuff Road. There were no people at the scene. I walked around the burned area and took photos of the buildings and the burned vehicles. The photos are attached to this report. Estimated loss is $215,000.00. I then responded to 5000 LeBuff Road (next door) and was met by Mr. Laurence LeBuff, the owner of 5000 LeBuff Road. Mr. LeBuff advised that he had evacuated the premises on Sunday and when he came back on Wednesday, the fire had destroyed his house and barn. He went on to say that he was uninsured. Thomas Raulerson Lee Williams Road Fire On 3/8/2017 I was requested by my chain of command to assist Inv. Feiner with a fire origin and cause investigation in Collier County. The fire occurred in or around the Picayune Strand State Forest and was assigned Florida Forest Service (FFS) number 2017-17-0088. The address for the origin of the fire was relayed to me as 5700 Lee Williams Rd. Naples, FL. On the same date at approximately 11:00 am I arrived at 5700 Lee Williams Rd. I approached the area from the south on Lee Williams Road and stopped at the edge of the burned area. There I met with Inv. Feiner and Lt. Hochuli. We discussed the facts and circumstances related to the fire and weather conditions on 3/5/2017, the date of the fire. FFS reported that at the time the fire was reported the winds were out of the ENE at 18mph and the relative humidity was 38%. A check of the Florida Automated Weather Network historical data showed that the ENE winds with speeds ranging from 17 to 27 mph were present for most of the day on 3/5/2017. From Lee Williams Road I looked east and was able to observe approximately a third of an acre that had burned. This area was bordered on the west by Lee Williams Road. The south side property was bordered by a chain link fence and power line that paralleled the property line. The east side of the burned area was bordered by unburned vegetation. On the north side of the fire was a path/driveway for entering and exiting the property from Lee Williams Road. The entrance from Lee Williams to the property was gated. During Fire suppression activities FFS firefighters had cut in a plow line around the entire burned area at 5700 Lee Williams Road. I entered the burned area from Lee Williams along the south side of the burn. As I walked to the east I observed burn patterns, charring and freezing that would indicate I was in the area of a flanking fire. As I continued to the east I observed the power pole, carrying the powerline, was well clear of the burned area to the east and showed no signs of damage or arcing. As I proceeded, I began to turn to the north transitioning to the heel of the fire. All indicators showed this to be an area of backing fire. I continued around the fire and as I approached the driveway on the north side of the fire the indicators again revealed a flanking fire. As I followed the driveway toward Lee Williams road, I entered an area were the intensity of the fire was very low. I conducted a closer examination of this area. This area had a thick layer of pine needles that burned only on the top layer of needles. If the ground in this area was disturbed it revealed unburned fuel. This burned area was outside of the line cut in by FFS. I followed it north for approximately 20 feet to the center of the driveway. On the driveway was a spot approximately 18 inches in diameter, where the debris on the ground was almost completely consumed. This spot was about 15 feet from the entrance gate to the property. When standing on the north side of the driveway, behind the burned area there appears to be a “V” pattern that burned to the south to the area of the main fire. I was able to determine that this area is in the area of origin but it is unclear if this area burned before or after the plow line was cut in by FFS personnel. This area of origin is consistent with a low intensity fire that burned from this area of origin to the South, 20 to 30 feet, until finding sufficient fuel to flare up and have the prevailing ENE winds cause the fire to spot over Lee Williams Road. After spotting over the road the fire created a head fire that continued to burn to the WSW. A thorough search of the origin area was conducted and no evidence of an ignition source was located. Based on investigative findings, equipment use, normal human activity nor intentional lighting of the fire can be ruled out as a cause of this fire. Therefore, the cause of this fire is undetermined
