EXECUTIVE SUMMARY
Recommendation to approve the first amendment to the Agreement for Impact Fee Payment
Refund between Haynes Corporation and the Board of County Commissioners, which corrects a
scrivener’s error on the number of jobs required for validation.
OBJECTIVE: That the Board of County Commissioners (Board) approve the first amendment to the
Agreement for Impact Fee Payment Refund between Collier County, Florida and Haynes Corporation.
CONSIDERATIONS: On December 10, 2013, the Board directed the County Manager and the County
Attorney to prepare program agreements with Haynes including this Impact Fee Payment Refund
Agreement based on Haynes Corporation’s originally-approved application.
Haynes Corporation entered into three agreements with the County. The Job Creation Incentive
Agreement entered into December 10, 2013, and the Job Retention Incentive Agreement entered into
December 10, 2013 both required that 17 jobs be created and the Impact Fee Payment Agreement
mistakenly required that 20 jobs be created for Haynes to qualify for the incentive. Staff believes that
“20” jobs is a scrivener’s error and it is in the best interest of the County and Haynes to correct the error
through this amendment.
FISCAL IMPACT: Haynes prepaid its impact fees on January 13, 2012, in the amount of $78,464.50
and following the findings of our final validation meeting will be reimbursed the amount prepaid, as
agreed upon in the Impact Fee Payment Refund Agreement. The recording of this agreement may incur a
fee. Sufficient funds are available in the Economic Development budget (001-138760) for the recording
expense.
GROWTH MANAGEMENT IMPACT: This request is consistent with Objective 3 of the Economic
Element of the Collier County Growth Management Plan, which states: “Collier County will support
programs that are designed to promote and encourage the recruitment of new industry, as well as the
expansion and retention of existing industries to diversify the County’s economic base.”
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - JAB
