Agenda 09/26/2017 Item #16D 909/26/2017 EXECUTIVE SUMMARY Recommendation to approve a First Amendment to the State Housing Initiatives Partnership (SHIP) Sponsor Land Use Restriction Agreement (LURA) between Collier County and Big Cypress Housing Corporation that corrects a scrivener's error and clarifies terms and conditions. OBJECTIVE: To continue to promote affordable rental housing strategies for low- to moderate-income persons through SHIP. CONSIDERATIONS: On June 28, 2016, Agenda Item 16.D.17, the Board approved a State Housing Initiative Partnership Sponsor Agreement awarding Big Cypress Housing Corporation $500,000 of SHIP to acquire and/or rehabilitate rental property. The State Housing Initiative Partnership Sponsor Agreement requires Big Cypress Housing Corporation to rehabilitate rental units at Main Street Village located at 104 Anhinga Circle, Immokalee, Florida and that a minimum of 40 units will be rented to income eligible tenants. This requirement is also set forth in a Land Use Restriction Agreement (LURA) that enforces the requirements of the State Housing Initiative Partnership Sponsor Agreement until June 1, 2031. This item is an amendment the LURA. The First Amendment to the LURA: 1. Corrects a scrivener's error in the address and adds a legal description for the property; 2. Clarifies the income limit of the beneficiary population to be served; 3. Clarifies the effective date of the commencement of the fifteen-year period of affordability; 4. Clarifies the term end date by adding reference to the final certificate of completion for the work funded with the grant monies. Big Cypress Housing Corporation will perform the overall contract management and administrative tasks as it relates to this project. FISCAL IMPACT: Funds are available within SHIP Grant Fund 791, Project 33429. The proposed action does not have an impact on the General Fund due to a recent notification of state funding, which will provide future administration throughout County FY17. LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: There is no growth management impact. RECOMMENDATION: To approve and authorize the Chairman to sign the First Amendment to a State Housing Initiative Partnership Sponsor Land Use Restriction Agreement.
