EXECUTIVE SUMMARY
Recommendation to approve a Drainage, Access and Maintenance Easement for the donation of an
easement parcel (109DAME) required for routine maintenance of the SR29 Canal. Estimated fiscal
impact: $44.
OBJECTIVE: To acquire an easement needed for maintenance of the SR 29 Canal.
CONSIDERATIONS: Global Signal Acquisitions IV LLC (Global) has agreed to donate to Collier
County a Drainage, Access and Maintenance Easement (Parcel 109DAME), needed for routine
maintenance of the SR 29 Canal. Our in-house appraiser has estimated the value of this parcel to be
approximately $6,000. Global has required that their standard format easement document be used as
opposed to our pre-approved format document.
FISCAL IMPACT: Funds in the amount of $44 are available in the District 5 Road Construction cost
center (163645). The estimated annual costs for this maintenance is between $60,000 and $80,000,
depending on rates of vegetation growth and rainfall. The source of funds is Unincorporated General
Fund (111).
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority for Board approval. - JAB
GROWTH MANAGEMENT IMPACT: This Project is in accordance with the goals, objectives, and
policies of all applicable sections of the Stormwater Management and the Conservation and Coastal
Management elements of the Growth Management Plan.
RECOMMENDATION:
(1) Approve the attached Drainage, Access and Maintenance Easement and authorize the Board’s
Chairman to execute same on behalf of the Board;
(2) Accept the conveyance of Parcel 109DAME to Collier County and authorize the County Manager
or his designee to record the conveyance instrument in the public records of Collier County,
Florida;
(3) Authorize the payment of all costs and expenses necessary to close this transaction;
(4) Authorize the County Manager or his designee to take the necessary measures to ensure the
County’s performance in accordance with the terms and conditions of the agreements; and
(5) Approve any and all budget amendments which may be required to carry out the collective will
of the Board.
