EXECUTIVE SUMMARY
Recommendation to approve final acceptance of the sewer facilities for Germain Auto Images,
PL20160000439, and accept unconditional conveyance of a portion of these sewer facilities.
OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the
Collier County Water-Sewer District, approve final acceptance of the sewer facilities, and accept
unconditional conveyance of a portion of these sewer facilities, in accordance with the Collier County
Utility Standards and Procedures, Ordinance No. 2004-31.
CONSIDERATIONS:
1) The Developer of Germain Auto Images, has constructed the sewer facilities within dedicated
easements to serve this private development (see attached Location Map). A portion of the sewer
facilities will be conveyed to the County, as described in Official Records (O.R.) Book 5297, Page
(PG) 3452. The remaining sewer facilities will be private.
2) Collier County Public Utilities Department granted Germain Auto Images a utilities deviation that
permitted the project to deviate from the standard utilities acceptance process. The deviation allowed
the project to go straight into utilities final acceptance without the 1 year warranty and performance
security that is typically required after utilities preliminary acceptance. Public Utilities staff justified
the deviation based on having no history of required warranty repairs on lateral/cleanouts. They also
noted that the cost of the pipe itself is less than $500, further justifying the lack of need for a
warranty period and performance security. The value of these sewer utility facilities (assets) is
$383.38. (See attached Asset Sheet).
3) The sewer utility facilities were not required to have the standard one-year warranty period. Public
Utilities staff is in the process of making changes to Ordinance No. 2004 -31 to allow single and
double wastewater lateral/cleanouts, as well as water main service connections avoid the one-year
warranty period.
4) Staff recorded all acceptance documents associated with the sewer facilities conveyed to the County
in the public records of Collier County, which were reviewed and approved by the County
Attorney’s office as to form and legality. The County acquired its interest in a portion of the sewer
facilities by Utilities Facilities Warranty Deed and Bill of Sale recorded in O.R. Book 5297, at PG
3452 of the Public Records of Collier County, Florida.
5) The on-site sewer utilities, less the sewer utilities described in O.R. Book 5297, PG 3452, are owned
and maintained by the developer.
6) Staff recommends final acceptance of the subject utility facilities.
7) This final acceptance is in accordance with Collier County, Ordinance No. 2004-31, as amended.
8) Staff is unaware of any issues that would serve to negate this recommendation.
FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact.
However, approval of this Executive Summary will result in the Collier County Water -Sewer District
receiving unconditional title to a portion of the sewer utility facilities, which has a total gross value of
$383.38.

GROWTH MANAGEMENT IMPACT: Approval of this Executive Summary will have no growth
management impact.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval -SAS
RECOMMENDATION: To approve final acceptance of the sewer facilities for Germain Auto Images,
PL20160000439, and accept unconditional conveyance of a portion of these sewer facilities, as described
in OR Book 5297, PG 3452.
