Agenda 09/26/2017 Item #11F09/26/2017 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners (Board) suspends all non-life/safety Collier County codes, rules, and regulations regarding replacements of mobile homes damaged by Hurricane Irma for 90 days. OBJECTIVE: To expedite the recovery from Hurricane Irma. CONSIDERATIONS: Hurricane Irma has devastated many Collier County mobile homes. To aid in the recovery efforts, staff is requesting that the Board suspends all non -life/safety Collier County codes, rules, and regulations regarding replacement of mobile homes for 90 days, which can be later extended by the Board, if needed. This predominately means a waiver of any required Site Improvement Plan submittal for older mobile home parks. This suspension is intended to be limited to like-for-like mobile home replacements and does not allow for an increase in number of mobile homes located in any park. All State and/or Federal requirements, such as the standards required by the Florida Building Code, Florida Department of Health, Flood Damage Prevention Ordinance, and fire codes, will remain in effect and any required permits, which are predominately building permits, will be required. FISCAL IMPACT: There is no fiscal impact associated with this action. GROWTH MANAGEMENT IMPACT: The Board should be aware there are two mobile home parks located in Immokalee that are inconsistent with the Future Land Use Element (FLUE) of the Growth Management Plan. Although replacing mobile homes that were destroyed by Hurricane Irma is appropriate to address the public health, safety and welfare of residents, establishing new mobile homes in these parks will be inconsistent with the FLUE. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority support for approval. -JAK RECOMMENDATION: To suspend all non-life/safety Collier County codes, rules, and regulations regarding replacements of mobile homes damaged by Hurricane Irma for 90 days.
