WHEREAS, the petitioner has requested a variance from
the Coastal Construction Control Line as required in Ordinance
75-19 for the purpose of constructing structures on the
following described property: .
LEGAL DESCRIPTION
A Description of Part of Section 8, Township 49 South,
Range 25, East, Collier County, Florida.
Pelican Bay Beach Facility Parcel at South Boardwalk:
All that part of Section 8, Township 49 South, Range 25
East, Collier County, Florida and being more particu-
larly described as follows: Commencing at the Southeast
corner of Section 8, Township 49 South, Range 25 East,
Collier County, Florida; thence along the South line of
said Section 8. South 89°30'59" West 161.46 feet;
thence North 7°05'09" West 3557.86 feet to the POINT OF
BEGINNING of the parcel herein described:
thence North 87°29'57" East 198.14 feet
to the Department of Natural Resources
Coastal Construction Setback Line; thence
along said Setback line North 6°00'42"
West 61.14 feet; thence continue along
said Setback Line North 4°23'30" West
560.55 feet; thence South 87°29'57" West
220 feet more or less to the approximate

- WHEREAS, the Community Development Administrator has '
reviewed said petition and has made a determination that the
granting of said petition is consistent with the require-
ments of Ordinance 75-19; and, 1

WHEREAS, the Board of County Commissioners has made a
'47-; finding that the granting of this petition is consistent
• with the intent and purpose of Ordinance 75-19;
NOW, THEREFORE, BE IT RESOLVED, by the Board. of County
Commissioners of Collier County, Florida, that Petition No.
CCSL-79-5-C be and the same is granted subject to the condi-
tions shown 'on Exhibits 1 and 2 dated October 2, 1979, and
bearing the signature of Neno J. Spagna, DPA, Community
Development Administrator, and subject to the following:
1. The granting of the petition is the least variance
required in order to permit the reasonable use of the
subject property which would otherwise be limited in
use due to the severe limitations of the established
Coastal Construction Control Line.
2. The granting of the petition is to permit the location
of a beach facility on or near the beach area in order
that it may adequately function and serve the need it
is designed to provide. Its location landward of the
Coastal Construction Control Line would severely limit
its use in a manner which is not in the best interest
of the general need of the citizens of Collier County.
3. The granting of the variance complies with the general
intent and purpose of Ordinance 75-19,
• 4. The granting of this variance does not constitute an
approval of the exact location of the structures or any
type of waiver of the zoning regulations.
5. Any required variance from the zoning requirements must
be requested by the petitioner and' processed through
the Board of Zoning Appeals as provided by law.
6. The granting of this variance shall not be valid unless
the petitioner receives a variance from the State
Cabinet from the State Regulations governing the Coastal
Construction Control Line.
BE IT FURTHER RESOLVED, that this Resolution be recorded
in the minutes of this Board.
