5. The Chairman's signature line date has been entered as the date of BCC approval of the JH
document or the final negotiated contract date whichever is applicable.
6. "Sign here"tabs are placed on the appropriate pages indicating where the Chairman's
signature and initials are required.
7. In most cases(some contracts are an exception),the original document and this routing slip
should be provided to the County Attorney Office at the time the item is input into SIRE.
Some documents are time sensitive and require forwarding to Tallahassee within a certain
time frame or the BCC's actions are nullified. Be aware of your deadlines!
8. The document was approved by the BCC on December 13,2016 and all changes made
during the meeting have been incorporated in the attached document. The County
Attorney's Office has reviewed the changes, if applicable.

CONSENT AND SUBORDINATION
THIS CONSENT AND SUBORDINATION (this"Consent") is given by CLI CAPITAL, a
Texas real estate investment trust("Mortgagee").
RECITALS
WHEREAS, Mortgagee holds a security interest in a portion of the land(the"Mortgaged
Property")situated in the County of Collier, State of Florida pursuant to a mortgage recorded in Book
5314 at Page 1134, as modified by that certain Modification of Real Estate Lien Note, Liens and Other
Documents, recorded March 2, 2017 in O.R. Book 5367, Page 3701, all in the office of the Clerk of the
Circuit Court, Collier County, Florida(the"Mortgage"); and
WHEREAS, Red Apple at Collier, LLC ("Mortgagor"), has platted the Mortgaged Property, as
more particularly set forth in the plat recorded in Plat Book at Page in the office of the Clerk
of the Circuit Court, Collier County, Florida(the "Plat"); and
WHEREAS, Mortgagor has requested that Mortgagee consent to the Plat and subordinate the lien
of, and all of its other rights, title and interest in, to and under, the Mortgage to the provisions of the Plat.
AGREEMENT
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which
are hereby acknowledged, Mortgagee hereby consents to and agrees to the terms of the Plat, hereby
consents to the execution and recording thereof, and further subordinates the lien of, and all of its right,
title and interest in and to the Mortgage and the Mortgaged Property to the dedications, restrictions,
covenants, and conditions of the Plat.
