Agenda 07/11/2017 Item #16C 707/11/2017 EXECUTIVE SUMMARY Recommendation to approve an Agreement for Sale and Purchase with William Lindsay, as Trustee, for 15 acres of vacant land immediately adjacent to the Collier County Landfill for the Solid and Hazardous Waste Management Division, at a total cost not to exceed $181,500; Project 59012, and authorize the necessary budget amendment. OBJECTIVE: To further the county’s good neighbor policy by acquiring property from willing sellers within Sections 30 and 31 east of the Collier County Landfill to secure lands which can serve as a natural buffer for the landfill, and potentially provide future development of additional areas for stormwater management, natural vegetative preserve and/or ancillary uses. CONSIDERATIONS: On December 5, 2006, the Board approved the Integrated Solid Waste Management Strategy (ISWMS) which set forth the Enduring Guiding Principles for environmental and Growth Management compliance, airspace preservation, operational excellence and best value service. Those guiding principles were ratified by Ordinance 13-08, the Solid Waste Sub-Element of the Public Facilities Element of the Growth Management Plan (GMP). Both the Solid Waste Sub-Element of the GMP and the ISWMS, set forth that the County “shall pursue the acquisition of land inventory” and to optimize the current solid waste management infrastructure. On June 11, 2013, the Board discussed bringing offers received for land sales to the Board for consideration and potential action on Item 15B. Immediately adjacent to the County’s landfill on the east side are several five acre parcels, including three vacant parcels, Folio Numbers 00339960002, 00340160008 and 00341400000, in Section 31 owned by William Lindsay, as Trustee. County Real Property Management staff became aware of the listing by William Lindsay for the listing price of $199,000. An in-house market valuation indicated a per acre price of $15,000 - $17,000. The owner has agreed to a selling price of $180,000, or $12,000/acre. The Agreement for Sale and Purchase has been reviewed and approved by the County Attorney’s Office, the Solid and Hazardous Waste Management Division and the Seller. FISCAL IMPACT: The total cost of the acquisition should not exceed $181,500 ($180,000 for the purchase price and $1,500 for a title commitment, title policy, closing costs and recording of the documents). A budget amendment is needed in the amount of $100,000, the 305 Master Plan project 70171 will be reduced by $50,000 and another $50,000 will come from the North Collier Hazardous Waste project 70168. The source of funding is Solid Waste user fees. LEGAL CONSIDERATIONS: Ordinance No. 2007-28 sets forth the Policies and Procedures governing the appraisal of lands and easements proposed for purchase by Collier County. Purchases of less than $1,000,000 are required to be appraised by at least one licensed, state certified real estate appraiser who is a salaried employee of the Board. This item complies with the Policies and Procedures and accordingly is approved as to form and legality, and requires majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This transaction is consistent with the County’s Growth Management Plan, specifically the Solid Waste Sub-Element. RECOMMENDATION: 07/11/2017 1. To approve the attached Agreement. 2. To authorize the Chairman to execute the Agreement and any additional closing documents, and accept the Warranty Deed, once approved by the County Attorney’s Office. 3.
