EXECUTIVE SUMMARY
Recommendation to approve an Ordinance to amend the Collier County Code of Laws and
Ordinances to reduce the maximum allowable off-site stormwater discharge rates in sixteen (16)
additional basins, and to modify the names of five existing basins with restricted discharge rates.
OBJECTIVE: To approve an Ordinance amending the Collier County Code of Laws and Ordinances to
add sixteen new maximum allowable off-site runoff discharge rates by basin, ranging from 0.04 cubic feet
per second per acre to 0.13 cubic feet per second per acre.
CONSIDERATIONS: Background: The existing conveyance capacity of the County’s primary and
secondary stormwater and surface water management system is limited. Expansion or enlargement of this
system to create additional system capacity is not a viable strategy for managing stormwater flows. The
Stormwater Management Subelement of the Growth Management Plan (GMP) requires a drainage system
to have adequate stormwater management capacity at the time a development permit is issued, and that
the system be designed “to ensure that the final outlet point has the adequate capacity to handle all
discharges from the upstream portion of the watershed under conditions present at the time of design.”
Additionally, Policy 6.3 of the Subelement requires off-site discharge rates be computed using a storm
event of a 3 day duration and 25 year return frequency. Previously completed analysis of the system’s
capacity to accept flow and adequately convey it to downstream receiving waters resulted in the current
maximum allowable post development discharge rates. Six (6) basins have a specified reduced maximum
allowable post development discharge rate; these range from 0.04 to 0.13 cfs per acre. All other basins
have a maximum allowable post development discharge rate of 0.15 cfs per acre.
The Conservation and Coastal Management Element (CCME) of the GMP, adopted in 1989, required that
the County develop a watershed management plan by January 1993. After postponement for several
years, the Board of County Commissioners (Board) sponsored development of a comprehensive Collier
County Watershed Management Plan (CCWMP) and accepted it in 2011. The unit discharge rates
adopted in the earlier years were based on preliminary hydraulic analyses. Detailed hydraulic modeling
for evaluation of the design storm conveyance capacity of the canal network performed as a part of the
CCWMP updated what the maximum allowable discharge rates should be for all of the basins. Two
additional detailed stormwater management master plans, developed jointly by the South Florida Water
Management District (SFWMD) and the County for the Belle Meade and Immokalee areas, recommended
limiting discharge rates for the basins within those planning areas.
As a result, amendments to the Collier County Code of Laws and Ordinances are needed to incorporate
the limiting discharge rates proposed in CCWMP and the two stormwater master plans. The following
benefits are anticipated as a result of these limiting discharge rates:
Improved levels of service (LOS) for flood protection provided by SFWMD and County
operated canals;
Enhanced groundwater recharge potential;
Restored hydrology and wetlands hydroperiod;
Water quality improvement of receiving waters;
Reduction of freshwater flows to the estuaries;
Gain consistency in Environmental Resource Permitting (SFWMD and County).
The Stormwater Management Subelement presently contains discharge rates either by specific basin or by
a single discharge rate for all remaining basins. However, some of these rates are incorrect and/or do not
reflect the recommended rates in the Collier County Watershed Management Plan or other studies. The
Board provided staff direction to remove these discharge rates from the Stormwater Management
Subelement and instead place them - as proposed for revision herein - in the Code of Laws and
Ordinances. Removing the discharge rates from the GMP and incorporating them into the Code of Laws

and Ordinances will allow for an amendment process, as future changes may be needed, that is faster, less
costly and less cumbersome. (This amendment to the Code of Laws and Ordinances is a companion item
to the GMP amendment to remove discharge rates from the Stormwater Management Subelement; it will
become effective on the same date as the GMP amendments - + August 2, 2017).
Stormwater Management staff and the County’s consultant presented a study to the Development
Services Advisory Committee (DSAC) on December 7, 2016, in support of limiting stormwat er discharge
rates in 16 Basins. This study included a comprehensive evaluation of potential financial impacts on
future development and redevelopment projects within the affected areas and the benefits to the drainage
canal network resulting from the implementation of the proposed discharge rate reductions. Presentations
to the DSAC were also made on June 3, 2015, November 4, 2015, and March 2, 2016.
At the April 20, 2017 Collier County Planning Commission (CCPC) Meeting, Stormwater Management
staff presented an amendment to the Code of Laws and Ordinances to reduce discharge rates in sixteen
additional basins and the CCPC forwarded the amendment to the Board with a recommendation of
approval. Subsequent to the meeting, staff revised the names of various basins, including five of the six
existing basins, for uniformity with various basin studies. The physical boundaries of these basins are not
being changed and the name changes have no regulatory effect. Accordingly, staff is of the opinion there
is no need for the CCPC to re-review this amendment.
FISCAL IMPACT: The fiscal impact for amending the Code of Laws and Ordinances is the staff time
needed to prepare the amendment and the cost to provide public input. These costs will be
accommodated in the current fiscal year budget.
GROWTH MANAGEMENT PLAN (GMP) IMPACT: This item has no Growth Management Plan
(GMP) impact; it implements policies in the Stormwater Management Subelement and the Conservation
and Coastal Management Element of the GMP.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires a majority
vote for Board approval. -- HFAC
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION: The CCPC
heard this item at their April 20, 2017 meeting, and forwarded the a mendment to the Board with a
recommendation of approval. (Vote: 6-0)

Stormwater Management Discharge Rate Restriction History
—1974 –Ordinance 74-50 Establishes Collier County Water Management Policy and
implements local design criteria.
—1982 –South Florida Water Management District establishes Pre-development verses
Po st-development matching discharge design criteria.
—1989 –Collier County adopted its first Growth Management Plan (Ord. 89-05) requiring

General Approach for Regulatory Impact Analysis

Final Presentation on 12/07/16:
Stormwater Planning staff and County consultant,Emilio Ro bau,presented
a study in support of limiting stormwater discharge rates in 16 Basins.The
study included a comprehensive evaluation of potential financial impacts on
future development and redevelopment projects within the affected areas
and the benefits to the drainage canal network resulting from the
implementation of the proposed discharge rate reductions.
DSAC vote:
—14-0 to endorse the report/study and its findings.
—11-3 to forward a re commendation to the Board of County Commissioners to
reduce the discharge rates in 16 Basins,as presented by staff.
