EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners (Board) approves and authorizes the
Chairman to execute the attached Deed of Release from the Federal Aviation Administration to
allow certain non-aeronautical land uses at the Immokalee Regional Airport.
OBJECTIVE: To stimulate economic development at the Immokalee Regional Airport (IMM) by
releasing certain aeronautical land-use provisions in support of the Immokalee Culinary Technology
Campus.
CONSIDERATIONS: In accordance with the Mission Statement, the Collier County Airport Authority
will “operate and develop these valuable, publicly owned assets for the benefit of the citizens and
taxpayers.”
With consideration to this mission, County/Airport management staff has requested from the Federal
Aviation Administration (FAA) a release of certain land-use encumbrances over a parcel of land at the
Immokalee Regional Airport (IMM), which require that airport property be utilized for aeronautical
purposes, as further identified in the Quitclaim Deed from the United States of America to Collier
County, dated January 26, 1960. The parcel is located at 170 Airpark Boulevard (Incubator II), and is the
location of the Immokalee Culinary Technology Campus.
In accordance with Federal Aviation Regulations, a release of aeronautical use provisions of real property
is only granted when it is clearly shown that such use of airport property will benefit civil aviation by
producing an equal or greater benefit to the airport than continued retention of aeronautical use. The FAA
has concluded that this property, as described in the attached Deed of Release, meets the conditions for a
release of the aeronautical use provision, and that the use of such land will not interfere with the
operation, maintenance or future development of the airport. The subject parcel is not currently used for
aeronautical purposes, nor is such use contemplated in the future.
The Board’s approval of this Deed of Release is consistent with the Authority’s Mission Stateme nt, and
will allow the Authority to pursue and accept external grant-funding opportunities to improve the property
for non-aeronautical uses in support of the Immokalee Culinary Technology Campus.
FISCAL IMPACT: There is no fiscal impact associated with the Board’s acceptance of the Deed of
Release.
GROWTH MANAGEMENT IMPACT: The Immokalee Airport Operations Planned Unit
Development (BCC Ordinance 10-07) allows a broad range of aeronautical and non-aeronautical land
uses. The Board’s acceptance of this Deed of Release is consistent with permitted land uses contained
within the PUD.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, is
approved as to form and legality, and requires majority vote for approval. -JAB.
RECOMMENDATION: To approve and authorize the Chairman to execute the attached Deed of
Release from the Federal Aviation Administration, and authorize the County Manager or his designee to
execute the Release of Aeronautical Use Provisions accepting the conditions of this release.
