Agenda 06/13/2017 Item #16E206/13/2017 EXECUTIVE SUMMARY Recommendation to repeal Resolution No. 2017-83, which implemented immediate limitations on outdoor burning due to extreme drought conditions, thereby ending the “Burn Ban” in accordance with Ordinance No. 2009-23, as amended. OBJECTIVE: To end the current outdoor burn ban as drought conditions have eased. CONSIDERATIONS: On May 12, 2009, the Board of County Commissioners (Board) adopted Ordinance No. 2009-23, known as the "Regulation of Outdoor Burning and Incendiary Devices during Drought Conditions Ordinance,” to provide a mechanism by which the Board may implement an immediate ban of outdoor burning and outdoor ignition sources during extreme drought conditions. Ordinance No. 2009-23, as subsequently amended, is codified in Section 58-1 of the Code of Laws and Ordinances. On April 25, 2017, and in response to current wildfire conditions and local evacuations, the Board ratified Proclamation/Resolution 2017-82, declaring a State of Emergency and approved Resolution No. 2017-83 implementing an outdoor burning ban in accordance with Ordinance No. 2009-23, as amended. It is the opinion of the local Fire Chiefs, the Director of the Bureau of Emergency Services, and the Division of Forestry that this ban is no longer necessary. FISCAL IMPACT: There is no fiscal impact. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: To repeal Resolution No. 2017-83 to end the current outdoor burn ban.
