EXECUTIVE SUMMARY
Recommendation to approve a Consent of County document authorizing the Naples Zoo to enter a
solar lease agreement with the Florida Power & Light (FPL) Company.
OBJECTIVE: To provide the County's Consent to a lease between Naples Zoo and FPL to install
renewable power generating equipment in the parking lot, as required by the Lease Agreement.
CONSIDERATIONS: On April 7, 2017, the Naples Zoo asked the Board of County Commissioners to
authorize a solar lease agreement with FPL to install renewable energy generating equipment, resulting in
an approximately 100 space solar canopy on County-owned land that is currently leased to the Naples
Zoo.
By Novation Assignment of Lease Agreement dated December 19, 2005, between the Trust for Public
Land, a California not-for-profit corporation and Collier County, with respect to the Lease Agreement
between Lease Agreement dated December 12, 2005, between the Naples Zoo, Inc. a Florida non-profit
corporation, and the Trust for Public Land, a California non-profit corporation, Naples Zoo requires
Board approval to enter this agreement with FPL. The lease states that the Lessee (Zoo) shall not assign
the Lease Agreement nor attempt to sublet the whole or any part of the Demised Premises, or permit any
other person(s) to occupy the same without the expressed prior written consent of the Lessor (County).
The County Attorney’s Office has advised that the agreement with FPL should be between the Naples
Zoo and FPL, with the written consent of Collier County, and the approval of the Conservancy of
Southwest Florida, and the Florida Communities Trust (FCT) approval. Subsequently, FCT advised
County staff that a 2012 land swap removed the parking area from being subject to FCT conditions. The
Conservancy of Southwest Florida supports the project moving forward. The Consent of County
document, attached as Exhibit F to the Solar Sublease Agreement will serve as the written approval of the
Board.
Installation, maintenance, repair, and replacement costs of any equipment will be borne by FPL. The lease
includes an annual rent payment of $4,000 from FPL to Naples Zoo.
The installation of solar panels is consistent with the Zoo’s conservation and education mission and will
promote the benefits of solar energy to the nearly 400,000 people who visit the Zoo annually. The solar
installation will also provide Zoo visitors with approximately 100 shaded parking spots, which is an
ongoing request to Zoo management. Finally, the installation of solar panels would allow the new Zoo
entrance project to earn points for environmentally friendly actions taken during construction in the
Leadership in Energy and Environmental Design (LEED) program.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
