EXECUTIVE SUMMARY
Recommendation to repeal and replace Resolution No. 96-63 to allow for the use of funds from the
Animal Control Neuter Trust Fund to provide free or low -cost spay and neuter for the public who
own breeds and types of animals most often relinquished to Domestic Animal Services (DAS), and
to declare a public purpose for the solicitation, receipt, and expenditure of donations and grants.
OBJECTIVE: To provide free or low-cost spay and neuter for the breeds and types of animals most
commonly relinquished to DAS in agreement with the Division’s mission to work toward ending the
community problem of pet overpopulation.
CONSIDERATIONS: Section 823.15, Florida Statutes, requires that dogs and cats adopted from the
County must be sterilized to reduce their uncontrolled breeding.
Resolution No. 96-63 defines the funding sources for the spay/neuter trust fund which was used to
sterilize all dogs and cats adopted from DAS. The spay/neuter trust fund is financed by:
A. $2 fee for each non-neutered and non-spayed animal license sold
B. $25 Spay/neuter fee for each dog adopted from the County
C. $20 Spay/ neuter fee for each cat adopted from the County
In January 2002, DAS hired a full-time Shelter Veterinarian to perform sterilization for all animals
adopted from DAS. The spay/neuter trust fund is currently used to fund surgeries at participating
veterinarians when the Shelter Veterinarian is not able to perform surgeries.
On September 9, 2008, the Collier County Animal Control Ordinance was amended to require mandatory
sterilization for animals impounded as strays. Owners are required to pay fees for services established by
resolution.
On June 14, 2016, the Board adopted Resolution No. 2016-125, section III, Agenda # 16.D.12, which
eliminated the $25.00 spay/neuter fee for dogs adopted from the County and the $20.00 spay/neuter fee
for cats adopted from the County.
The appropriation of fees from 1996 when the Resolution No. 96-63 was adopted needs to be amended to
be in alignment with the Collier County Animal Control Ordinance and Resolution No. 2016-125.
Providing no-cost spay/neuter services to the public who own breeds and types of animals most often
relinquished to the shelter using funds from the Animal Control Neuter Trust Fund will supp ort DAS’
mission to work toward ending the community problem of pet overpopulation by reducing the number of
litters of puppies and kittens being produced within Collier County.
Allowing the acceptance of donations and grant funds in the Animal Control Neuter Fund will make it
possible to provide affordable spay and neuter programs to a larger number of animal breeds and enable
the fund to be self-perpetuating from year to year.
ADVISORY BOARD RECOMMENDATION: The Animal Services Advisory Board discussed this
issue and recommended 6-0 to amend Resolution 96-63 and to hire a part-time veterinarian utilizing funds
in the spay/neuter trust fund to perform low-cost and free spay and neuter surgeries for the public who
own breeds and types of animals most often relinquished to DAS.

FISCAL IMPACT: The total DAS revenue budget for Fiscal Year 2017 for spay/neuter fund (610) is
$19,300. Re-appropriation of certain fees from the General Fund (001) to the spay/neuter trust fund (610)
is approximately $83,000.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK

1. The County' s Animal Care Sterilization spay/neuter program for all dogs and cats to
be adopted from the County' s Animal Control Department shall be funded in part from

3 2. The administration of the neuter/ spay program shall be under the direction of the
County’s Director of Animal Control. Accounting for the disbursement of the spay/
neuter fees shall be in accordance with procedures of the County’s Finance Department.
Collier County Domestic Animal Services may operate affordable spay and neuter
programs in part or in whole, with the Animal Care Sterilization Trust Fund dollars so
long as funds for that purpose are available. The Animal Care Sterilization spay/ neuter
program must cease at those times, if any, that there are both (a) insufficient funds in the
spay/ neuter Animal Care Sterilization tTrust fFund to pay the fees and (b) the Board of
County Commissioners has not otherwise made additional fiscal appropriations to cover
insufficient funds in the trust fund.
2 3. Upon verification that authorized services have been rendered by the veterinarian,
fees from the spay/ neuter Animal Care Sterilization tTrust fFund are to be paid to the
veterinarian, subject to availability or funds in that trust fund. The amount of the fee(s) to
be paid to the veterinarian for services rendered shall not exceed fees be as specified by
resolution. in the written Veterinarians who are engaged to perform sterilization services
at Domestic Animal Services or at a Domestic Animal Services sponsored event will be
paid at a daily or hourly rate to be agreedment upon between by the County Director and
the veterinarian.
4. The sale of dog licenses and cat licenses by veterinarians continues to be authorized
and the service fee of $ 1. 00 for each license sold continues to be allowed to each
Veterinarian who sells the license. Forms and license tags will be furnished by the
County to veterinarians.
4. Expenditures may be made from the Animal Care Sterilization Trust Fund to
supplement or enhance spay and neuter programs for the animals at Domestic Animal
Services and for the community, including low cost or free spay/neuter, other minor
medical procedures that may be required, acquisition of equipment and supplies to
provide sterilization for animals including medications, drugs, diagnostics, and other
related costs for sterilization services.

b. Reduced cost or free spay/ neuter is subject to terms and conditions from grants
received, or by breeds and/or types of animals most often relinquished to Collier
County Domestic Animal Services.
5. Any gifts, grants, awards or donations received subject to a condition shall be
expended strictly in accordance with such condition.
6. The animal services sterilization fund account shall be self-perpetuating year to year,
unless specifically terminated by the BCC.
7. Funds not expended at the close of any fiscal year shall be carried forward into the next
year.

COMMISSIONERS SUPERSEDING RESOLUTION NO. 2014-29 AMENDING
THE DOMESTIC ANIMAL SERVICES FEE POLICY TO PROVIDE
APPROPRIATE FEES FOR ALL SERVICES PROVIDED BY COLLIER
COUNTY DOMESTIC ANIMAL SERVICES AND TO ALLOW FOR WAIVERS
AND REDUCTIONS IN FEES WHERE NEEDED.
WHEREAS, on February 11, 2014, the Board adopted Resolution No. 2014-29 which
established a revised Fee Policy in accordance with newly adopted Animal Control Ordinance to ensure
a fair and uniform fee policy that identifies all services provided by Domestic Animal Services; and
WHEREAS, on October 13, 2015, the Board approved a shelter assessment conducted by a
team of veterinarians from Maddie's Shelter Medicine Program at the University of Florida
recommending giving the Director of Animal Services discretion to waive reclaim fees, when needed, to
keep animals in their homes and to reduce or waive adoption fees for promotional purposes; and
WHEREAS, the Director of Animal Services recommends that the Board of County
Commissioners amends Exhibit A of the Domestic Animal Services Fee Policy, as attached hereto; and
WHEREAS, the Board of County Commissioners hereby accepts the recommendations of the
Director of Animal Services.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY THAT:
Exhibit A to Resolution 2014-29 is hereby amended as depicted in the attached Exhibit A.
BE IT FURTHER RESOLVED that this policy becomes effective upon adoption of this
resolution.
This Resolution adopted this 114+11 day of I u n e r 2016 after motion, second and
majority vote in favor of passage.

COLLIER COUNTY DOMESTIC ANIMAL SERVICES
FEE POLICY
I. PURPOSE
The purpose of this policy is to establish user fees which will partially offset the cost of
providing domestic animal services to the taxpayers of Collier County.
II. LIMITATIONS
A. Waiving of Fees. The Board of County Commissioner shall set all fees and charges.
Fees may be waived in accordance with policies articulated herein, such as under certain conditions
upon reclaim, when fees are for animals in safekeeping. Fees for field surrenders and board for
quarantine may be waived at the discretion of the Director when to do so will prevent the suffering of an
animal or ensure public safety and no reasonable alternative to waiving the fee exists. Such waivers
shall be brought before the Board in quarterly reports for after-the-fact ratification.
B. Non-Fee-Related Policies. The Director of Animal Services, or designee, may waive
enforcement or application of any department policies or restrictions provided such waiver does not
conflict with applicable local, state, or federal laws and does not interfere with public safety.
C. Promotional Sales and Advertisements. Fees may be reduced for special promotional
sales and advertisements if approved by the Director of Animal Services and such a reduction is applied
in a consistent and time-limited manner.
D. Sponsored Fees. The department may accept cash donations to sponsor fees for
customers in need. Fee sponsorship donations will be accounted for as the sale of gift certificates to be
redeemed at the time of the fee-incurring transaction. Redemption of sponsored fee gift certificates will
be at the director's discretion in accordance with the following general guidelines: A customer cannot
benefit from sponsored fees more than once in a twelve-month period.
E. Reclaim Fees. Fees may be reduced or waived at the discretion of the Director of
Animal Services if such fees would facilitate a live release and allow for the animal to be returned to a
responsible home. Reducing and/or waiving of fees should only be utilized once all fee-sponsored
donations are exhausted. Collier County license and microchip are not subject to reduction or waiver of
fees.
F. Safekeeping. If an animal is impounded at the request of a first-responding agency due to
the death, medical emergency, or disaster-related circumstance of its owner or caretaker, and that animal
is claimed by the owner, next of kin, or otherwise authorized party at the first available opportunity,
impound, and board fees may be waived. This exception does not apply to animals of owners or
caretakers who have been arrested or incarcerated. Safekeeping animals are subject to all other

requirements of impounded animals at Domestic Animal Services as per Collier County Animal Control
Ordinance.
G. Refunds. The following fees are nonrefundable: Impoundment Fees, Owner Surrender
Fees (except as provided herein), License Fees (except as provided for herein), and Permitting Fees
except situations where the applicant is not approved for zoning as required by Collier County Animal
Control Ordinance). The following fees are refundable only if service is not rendered: Mandatory
Spay/Neuter Fees, Micro-chipping Fees, and Euthanasia and Cremation Service Fees may be refunded at
the discretion of the Director of Animal Services, or designee, upon written request received within 30
days of payment or receipt of service, whichever comes first.
Adoption fees are nonrefundable. Adopted animals may be returned before the 30th day of placement
without incurring an owner surrender fee. On the 31st day and all those thereafter, an owner surrender
fee will be incurred for adoption returns. Days are counted as calendar days, irrespective of Domestic
Animal Services open-to-the public hours. If an animal is returned within 30 days of placement, the
adopter may adopt a like type animal at no cost within 60 days of the original adoption. Adoption fees
may be refunded within ten (10) days from adoption if the adopter can demonstrate non-routine
veterinary medical expenses in excess of the amount of the adoption fee. Adoptions are considered "as
is," and no expenses beyond the adoption fee will be reimbursed. Adoption fees will not be reimbursed
if the adopter failed to sign up for free pet insurance offered by Domestic Animal Services.

C. $20.00 spay/neuter fee for each cat adopted from the
County.
2. Upon verification that authorized services have been
rendered by the veterinarian, fees from the spay/neuter
trust fund are to be paid to the veterinarian, subjoct to
availability or runds in that trust rund. The amount or
the fee(.) to be paid to the veterinarian for .ervices
rendered shall be as specified in the written agreement
between the County and the veterinarian.
3. The administration of the neuter/spay program shall be
under the direction of the County's Director or Animal
Control. Accounting for the disbursement or the
spay/neuter fees shall be in accordance with procedures of
the County's Finance Department. The spay/neuter program
must cease at those times, if any, that there are both (a)
insufficient funds in the spay/neuter trust fund to pay the
fees and (b) the Board of County Commissioners has not.

5. This Resolution repeals County Resolution No. 91-214.
