Box 990596 Naples, FL 34116 RE: Abandonment of a portion of 25th Avenue Collier County, FL Dear Mr. Ramsey, As you are aware Ryan Companies US, Inc. is the developer of new charter school that is under construction at the Southwest corner of 25th Avenue and 8th Street in the Golden Gate Estates neighborhood. As requested by the neighbors, we have designed the site such that there will be no connection between the charter school and the neighborhood. This is something that we understood to be very important to the immediate neighbors as well as the civic association. As part of the development process we are petitioning the Collier County board of county commissioners for the abandonment of the portion of 25th Avenue east of 8th Street to accommodate the neighbors'desire. Please refer to the attached drawings for parcel maps and site plans showing the area to be abandoned. The reason I have sent you this letter is to inform you of the pending abandonment and request a "Letter of No Objection." As part of the process in Collier County, the County requests that the petitioner offer a homeowners association an opportunity to review the abandonment and, if they have no objection, sign a Letter of No Objection. Per your request, we will agree to provide a landscape buffer in accordance with the attached buffer requirements should the school expand its operation north of the existing 25h Avenue easement area. We ask that our public land not be given to the school for their personal use and interests. This land serves as a minimal buffer to what has become a destructive impact on our neighborhood. A'glitch' in the zoning code allows charter schools to be built on residentially zoned property without any notification to the neighborhood. A charter school that includes a multi-story building, significant car traffic, hundreds of students and staff. When the neighborhood learned that the charter school was coming into our neighborhood, we requested and received public meetings.At the public meetings, the said portion of 25th Ave NE and adjacent vacant strip of land to the North was discussed. I personally raised the potential use of this land by the charter school with representatives of this Ryan Companies and charter school representatives. They"by their word" assured us that they would not pursue utilizing this section of 25th Ave NE nor the adjacent vacant strip of land to the North. They stated it would serve as a perpetual buffer to the local community. Additionally, in their words, there were no plans to utilize 25th Ave NE nor develop the vacant strip of land as the school had their own driveway immediately encircling the school. We were asked if we wanted access through the school. It was unanimously and resoundingly agreed by the neighborhood that NO access to the school was desired and we requested that they block all access from the school into our neighborhood. When the community members asked for it in writing, Ryan Companies indicated that they need not put it in writing, that their word was enough. We are here today.., their word was not enough .., nor has it been during the entire construction process. This land is public land. We ask that it remain public land and that the Commissioners deny this Resolution. We request that the Commissioners require the school to install additional landscape buffering and a fence around the property the school purchased. We also request that signage be placed at the entrance to the neighborhood off Immokalee Road and Wilson Boulevard indicating that there is no school access; all roads are indeed dead ends. Thank you for allowing a voice to ring out from the community. Thank you for preventing the destruction of our neighborhood by opposing this'gift' of County and public land to the charter school.
