Agenda 05/09/2017 Item #16K 105/09/2017 EXECUTIVE SUMMARY Recommendation to approve the hiring of Philip Greenwald, Esq., for mediation services relating to the Golden Gate Boulevard road widening Project No. 60040, and the eminent domain case styled Collier County v. GG1 Naples, LLC, et al., Case No. 15-CA-0329, now pending in the Twentieth Judicial Circuit Court for Collier County, Florida, and to authorize the County Attorney to retain Mr. Greenwald for future mediations in eminent domain litigation. (Fiscal Impact: $5,000) OBJECTIVE: To secure the mediation services of Philip Greenwald, Esq., to comply with Court directives in eminent domain litigation, and to enable the County to reduce further litigation costs by resolving disputes with property owners through mediation. CONSIDERATIONS: A substantial amount of eminent domain cases pursued by the County are resolved through mediation conducted by skilled and experienced mediators. The County Attorney’s Office (CAO) and opposing counsel in the referenced case have agreed on Mediator Philip Greenwald, Esq. Pursuant to Florida Statute § 73.091(1), the County is required to pay the cost of mediation in eminent domain cases. The CAO anticipates the cost to retain Mr. Greenwald as mediator in this case to not exceed $5,000, and requests the Board authorize his retention as mediator in any future eminent domain litigation under the terms of the attached fee schedule. FISCAL IMPACT: Funds in the amount of $5,000 will be paid from gas taxes and/or impact fees from Golden Gate Blvd. Project No. 60040. The primary funding source for the acquisition of right-of-way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been prepared by the County Attorney’s Office, is approved as to form and legality, and requires a majority vote for Board approval. - ERP RECOMMENDATION: That the Board of County Commissioners approve the hiring of Philip Greenwald, Esq., for mediation services relating to the Golden Gate Boulevard road widening Project No. 60040, and the eminent domain case styled Collier County v.
