EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign the Utility Facilities Quit-Claim
Deed and Bill of Sale between Collier County, as Ex-Officio Governing Board of the Collier County
Water-Sewer District, and Lennar Homes, LLC, in order to reconvey to Lennar Homes, LLC, all
sewer utility facilities associated within the development project at Giaveno, PL20140001923, which
were previously erroneously conveyed to the County.
OBJECTIVE: To correct the erroneous conveyance of sewer utility facilities to the County for the
Giaveno development project.
CONSIDERATIONS: The Utility Facilities Warranty Deed and Bill of Sale from Lennar Homes, LLC
(“Lennar”), recorded on March 27, 2015 at OR Book 5133, PG 2906, conveyed sewer utility facilities
located within Tract FD-2 (Plat Book 54, Pages 68-69) to the Board of County Commissioners (Board),
as ex-officio Governing Board of the Collier County Water-Sewer District.
These conveyance documents were recorded after preliminary acceptance of the utility facilities for the
project, in accordance with the Utility Facility Standards and Procedures Ordinance No. 2004 -31.
However, prior to Lennar requesting the Board's final approval and acceptance of these utility facilities,
the Development Review Division determined that the sewer utility facilities should not have been
conveyed to the County because the sewer utility facilities were meant to remain privately owned.
Therefore, the attached Quit-Claim Deed will reconvey the County’s interest in these sewer utility
facilities back to Lennar.
Lennar is aware of the error and has agreed to accept reconveyance of these utility facilities.
FISCAL IMPACT: There is no fiscal impact associated with this action.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - SAS
