Agenda 04/11/2017 Item #16A 304/11/2017 EXECUTIVE SUMMARY Recommendation to approve an Easement Use Agreement (Agreement) for Lot 7 Nature Pointe, according to the plat thereof as recorded at Plat Book 20, Pages 20 through 22 of the public records of Collier County. _____________________________________________________________________________________ OBJECTIVE: To approve an Easement Use Agreement between the County, the current property owner of Lot 7, Nature Pointe and the Nature Pointe Homeowner’s Association, Inc. CONSIDERATIONS: There is an existing paver deck and pool on the subject property that encroaches 14.8 feet into a 25-foot Drainage Easement. The subject easement is dedicated to Collier County with no responsibility for maintenance and to Nature Pointe Homeowner’s Association, Inc. with responsibility for maintenance, according to the plat. The Homeowner’s Association has provided a letter of no objection to the encroachment and stated that there remains sufficient area to maintain the easement. There are no drainage facilities within the easement and the Nature Pointe Homeowner’s Association, Inc. has joined into the Agreement. Development Review and the County Attorney’s Office have reviewed the Agreement and Exhibits and recommend approval of the Easement Use Agreement. The current owner purchased the property with the encroachment in place. FISCAL IMPACT: There is no fiscal impact. The property owner will be responsible for the recording fees. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. SAS RECOMMENDATIONS: To approve the Easement Use Agreement between the County, the current property owner of Lot 7 of Nature Pointe, and the Nature Pointe Homeowner’s Association. To authorize the Chairman to execute the Agreement and direct the Clerk to record the Easement Use Agreement.
