Agenda 03/28/2017 Item #16D 103/28/2017 EXECUTIVE SUMMARY Recommendation to approve a donation of $2,219.92 to the Conservation Collier program as offsite preservation for Comcast Data Facility (PL-20140002387) to satisfy the native vegetation retention requirement. OBJECTIVE: To accept an offsite preservation donation in the amount of $2,219.92 for the Conservation Collier Program. CONSIDERATIONS: The Land Development Code (LDC), Section 3.05.07, H.1.f. iii. a., allows for offsite native vegetation retention requirements to be met by monetar y payment to the Conservation Collier Program. Applicants may make a monetary donation to Collier County with funds to be used by the County for the purchase and management of off-site conservation lands within the county. The monetary payment is based on the location of the land to be impacted and shall be equal to 125 percent of the average cost of lands in that Designation, as defined by the Future Land Use Map (FLUM), purchased by Collier County through the Conservation Collier Program. The proposed donor, Cable Holdco II Inc., is requesting an insubstantial change to the original SDP (00- 95) to add a new data center shed. This project is located within the rural area as defined by the FLUM. The vegetation preservation requirement for this 1.14-acre parcel is 10% (0.114 acres), and the applicant has elected to fulfill their preserve requirement through an offsite monetary donation to Collier County for the Conservation Collier Program. One hundred and twenty-five percent (125%) of the average cost to Conservation Collier for lands within the rural area is $19,473 per acre. Therefore, $19,473 X 0.114 = $2,219.92. The submittal was approved administratively with stipulations in February 2015 (attached). One stipulation was that $2,010 shall be donated to Conservation Collier as payment in lieu of native vegetation requirement. Since the time of that administrative approval, the average cost of rural lands for the Conservation Collier program has changed slightly, incorporating the purchase of a new good-deal parcel, resulting in a slightly higher required donation amount of $2,219.92. FISCAL IMPACT: The donation is intended to provide funds for land acquisition and management of lands for the Conservation Collier Program. Of the total received, 80% ($1,775.94) will be placed into Fund 172, the Land Acquisition Trust Fund, and $443.98 will be placed into Fund 174, the Land Management Trust Fund, to be used for management of any newly acquired property. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board approval. JAB GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. RECOMMENDATION: To approve and authorize the donation of $2,219.92 to the Conservation Collier Program. This office has reviewed the plans and has no objection to the changes shown unless noted under stipulations. STIPULATIONS: Environmental Services - A contribution in the amount of $2,010.00 shall be made to Conservation Collier as payment -in -lieu of the native vegetation retention requirement by the time of pre -construction meeting. Engineering Services - Per the ROW Handbook Section III C.2.c, loose gravel, rock and ornamental stone are not permitted within the public ROW. The construction entrance shall be paved within the First Street NW right-of-way. SIGNAGE RESTRICTIONS: Please be advised that any permanent sign (wall, ground, monument, directory, etc.) requires a separate building permit and must meet the provisions of the Collier County Land Development Code, Section 5.06, and/or the applicable provisions of the governing Planned Unit Development (PUD) document, regardless of any sign placement, dimensions, or color depicted on the site and/or architectural plans approved by this letter.
