MR. MOREY: Also present with us is the Property Appraiser, Mr. Abe Skinner. MR. SKINNER: Hi. CHAIRMAN TAYLOR: And from the Property Appraiser's Office, Jeep Quinby. MR. QUINBY: Good morning. MR. MOREY: We also have a gentleman from the procurement office that will be speaking with you shortly. Page 2 March 6, 2017 So just a brief introduction and overview of the VAB process. We do this each time. And, in short, the Board's role is very important; it's one of oversight and compliance. In counties where you have a population greater than 70,000, this is truly oversight and compliance. The hearings and the petitions are heard in counties of that size by magistrates appointed by the Board. The magistrates hear everything, assure that the taxpayer is afforded the right of redress, to have their concerns heard with timely filed petitions. When a decision is made by the magistrate, it's boiled down to a written decision; they have findings of fact, conclusions of law, whether the petition's granted or denied, and whether or not there will be an adjustment to the just value and then subsequently to any assessed value. The Board appoints the magistrates. The Clerk to the Board -- by the way, the Clerk's Office does a fantastic job, Patricia Morgan, in particular, and her staff, putting this all together. And you appoint the magistrates, the hearings are scheduled, all of the decision are gathered, boiled down, and, ultimately, you approve those magistrate -- adopt the magistrates' decisions. So it's crucial. That's kind of an overview of the role. In terms of the first action item today, we're to ask you to review and approve today's agenda. CHAIRMAN TAYLOR: Are there any changes or additions to this agenda? MR. MOREY: No changes. We will be hearing some comment on the RFP process. CHAIRMAN TAYLOR: All right. Next, some general business discussion. And first, under 4A, selection of independent legal services, as the gentleman's coming to the podium. So one of the requirements for the VAB process is at all times for the Board to have an independent legal counsel, not county employee, outside independent legal counsel. And currently there is a contract that is through the end of May. It's the 27th or 28th of May. So before that lapses and to provide continuity of representation, there's an RFP process, and I'll turn it over. MR. COYMAN: Yes. Good morning. My name is Ted Coyman. I'm Director of Procurement Services for the county. CHAIRMAN TAYLOR: And I'd like to just add that we are very pleased that Mr. Coyman is now with us. He comes from a little bit further up the coast, I believe Sarasota area. MR. COYMAN: Sarasota County, correct. CHAIRMAN TAYLOR: And he is such a welcomed addition to our government here. And we know his name isn't Rhonda Burns or Brenda Brilhart, so I'm delighted you're here, sir, Mr. Coyman. MR. COYMAN: Thank you very much. I'm excited to be here. I wanted to give the Board an update on where the Procurement Office stands on the solicitation for legal counsel for the Value Adjustment Board. The solicitation is still currently being evaluated, and because the Board does not normally reconvene until August, what I want to ask is if the Board would be willing to hold a special meeting in the month of April to hear the recommendation from the Procurement Office on the award of that service. We did check with staff, and there are two available dates in the month of April. They're both Mondays. This would be April 3rd and April 17th, and I was asked to remind you that April 17th is the Monday immediately after Easter. CHAIRMAN TAYLOR: Easter Monday. Page 5 March 6, 2017 MR. COYMAN: So that might be a challenge. So I would need some direction on the willingness to meet, perhaps, on April 3rd. HOMESTEAD MEMBER EARNEY: I'm not going to be here in April or May. CHAIRMAN TAYLOR: We would still have a quorum; is that correct? MR. MOREY: We would need a quorum, yeah, just a quorum of three members of the board, and it must -- you three -- the remaining three members would be a quorum. BUSINESS MEMBER COHEN: I'm available both days. CHAIRMAN TAYLOR: Well, I hope Sherry's listening, because I'm pretty sure I'm okay. In fact, I should just check, but I'm pretty sure I'm okay. COYMAN: All right. We will do that. The reason for this is also, Mr. Morey indicated that the current contract to provide legal counsel expires on May 28th. So we need to have the next agreement in place prior to that expiration date. CHAIRMAN TAYLOR: Okay. I have a FAC conference then, but I'm not sure that I need to be in on that Monday. Just in case I do -- but I don't think I do. But just in case I do, would it be possible to start a little bit earlier on that Monday? Would that be objectionable to anyone? Agenda Item 4B, which is the status report for RFPs for special magistrates for the 2017 VAB cycle. So the RFPs are, in fact, out. They're listed there. It's applications for the real Page 7 March 6, 2017 property appraiser, special magistrate, tangible personal property appraiser, special magistrate, and attorney special magistrate. RFP #17-7047 is for appraiser special magistrates, and the attorney special magistrate is RFP #17-7048. So they are pending, and I suspect at the organizational meeting in August that the -- you will be presented with some selections from the results of those RFPs. CHAIRMAN TAYLOR: Mr. Morey? MR. MOREY: Yes. CHAIRMAN TAYLOR: Do we have to renew this on an annual basis? MR. MOREY: Excellent question. Ordinarily the contracts are -- ordinarily, it's a two-year contract with a potential renewal term. And it's just a good idea every couple of years to go through the process. There's, you know, preference to have some maybe local magistrates, and so a couple of years ago the Board kind of made it their pleasure that we review it every couple years. CHAIRMAN TAYLOR: Okay. That's fine. MR. MOREY: Yeah. SCHOOL BOARD MEMBER CARTER: Mr. Morris (sic), I have a question as well. When -- do we have a date in August yet when that's going to be? MR. MOREY: We may. HOMESTEAD MEMBER EARNEY: August 7th. MR. MOREY: August 7th. SCHOOL BOARD MEMBER CARTER: Thank you. MR. MOREY: You're welcome. SCHOOL BOARD MEMBER CARTER: I assume that will be in the morning again? Page 8 March 6, 2017 So that's Item B. 4C, which is updates from the Department of Revenue or the current legislative session affecting anything that we do here. The Department of Revenue adopted a rule change and adopted some form changes. In all honesty, nothing really earth shattering affecting our process. It really is kind of form -- form changes. The legislative session, there are three things pending. If it gets all the way through the session, they would be -- it would become effective July 1. The three changes are: There's -- first, there's a proposal to reimburse certain taxes with respect to folks that suffered hurricane damages in 2016 and rendered their homes uninhabitable or if it was motor homes for sale being destroyed. So there's -- there is pending legislation to offer some reimbursement to those folks affected. Property taxes: There are some proposed changes to delinquency status and being able to claim adverse possession, for example, and there are some other technical things that are pending. And, again, they have to make it through all the proper committees. And exactly where they are at the moment, I'm not sure. If they become effective, it would be July 1. If they do become effective, we'll give you a summary in the August meeting. And, finally, tax exemptions for first responders and surviving spouses of first responders. This is something that's also pending. So some additional exemptions for those folks. CHAIRMAN TAYLOR: Okay. MR. MOREY: Five, and which is typical, we don't have too many members of the public here, but it's public comment if anybody would like to comment. I don't see anyone in the audience, which is fairly typical. So next, next is the adoption of the special magistrates' recommendations for 2016. In August we typically go through a Page 9 March 6, 2017 complete recap of the total number of petitions filed, the total number heard, late filed petitions. We'll kind of give you all those statistics with a complete recap. But suffice it to say there are 136 magistrate decisions, so there were 136 petitions which boiled down to an ultimate magistrate decision. And you had a chance to -- I'm sure you had a wonderful, good time reviewing all the decisions, but that is something that I'm supposed to do and review, and the primary thing is I'm looking to make sure -- the role of the counsel is to make sure that they're in writing, there are finding of facts, there's a conclusion of law, and it's in the proper form. Really, form or substance. We're not second-guessing anyone's decision. And all of these are in the proper form. So we should go through each category, and there are six categories: Homestead petitions; other legal determination petitions; portability transfer petitions; exemption and classification petitions; tangible personal property; and tax adjustment petitions, residential and commercial. So we should go through each category and ask that the Board adopt the magistrate's decisions in that category. CHAIRMAN TAYLOR: All right. We'll start? MR. MOREY: Sure. So the first one would be homestead petitions. We would ask that you adopt the magistrate's decisions with respect to homestead petitions. I'm putting my commas in the correct place, because the next two items are to adopt the value -- certification of values with respect to tangible personal property and real property, and as I said, I have to work backwards. Okay. The first one is tangible personal property. So we would Page 13 March 6, 2017 ask the Board to certify the -- this is approval of the assessment role for the tangible personal property, and here are the figures: The taxable value of tangible personal property of the assessment role as submitted by the Property Appraiser to the VAB is $1,806,886,462. There was no net change as a result of the VAB process. So the final value would be $1,806,868,462. CHAIRMAN TAYLOR: Any discussion? (No response.) CHAIRMAN TAYLOR: All right. Hearing none, do I have a motion to accept the certification? SCHOOL BOARD MEMBER CARTER: I motion to accept the certification. HOMESTEAD MEMBER EARNEY: Second. So we would ask that the Board certify the value of real property as submitted by the Property Appraiser to the Value Adjustment Board, and I will read the starting value and then the final value as adjusted by this process. The starting value was $75,313,323,370. As a result of this process, there was a downward adjustment of$4,918,653, and the final assessment $75,308,404,717. CHAIRMAN TAYLOR: Mr. Morey? MR. MOREY: Yes. CHAIRMAN TAYLOR: I would assume that the downward Page 14 March 6, 2017 adjustment had to do with changes that we've-- it says according to the Board, so there have been some adjustments in the taxable value of folks' property? MR. MOREY: Yes, ma'am. Through that 136 petitions, some -- there were some granting of adjustments, and as a result of adjustments. CHAIRMAN TAYLOR: All right. Good. All right. Any other questions or discussion? BUSINESS MEMBER COHEN: Well, I would imagine that type of reduction isn't really going to put a dent in the budget to a detrimental? MR. MOREY: It's still a large tax base. I certainly welcome any comments, and it's not -- MR. SKINNER: As far as the budget, affecting the budget when you lower that, it would be minimal. It would be so -- we're dealing with, what, $75 billion -- MR. MOREY: Yes, sir. MR. SKINNER: -- taxable value, which was about 102 billion just value. So it's such a large figure there, and the amount that was changed is so small. MR. MOREY: Okay. MR. SKINNER: You wouldn't hardly notice it. BUSINESS MEMBER COHEN: I would image so, yes. MR. SKINNER: Small; a billion. CHAIRMAN TAYLOR: Extraordinary. BUSINESS MEMBER COHEN: Amazing, yeah. CHAIRMAN TAYLOR: Any other questions? (No response.) CHAIRMAN TAYLOR: Discussion? (No response.)
