EXECUTIVE SUMMARY
Recommendation to approve an Ordinance amending Ordinance No. 2016-41, the New Hope
Ministries Mixed Use Planned Unit Development (MPUD), to correct a Scrivener’s Error relating
to the maximum number of dwelling units allowed for the MPUD property located on the north
side of Davis Boulevard and east of Santa Barbara Boulevard in Section 4, Township 50 South,
Range 26 East, Collier County, Florida; and providing an effective date [SE- PL20170000356].
OBJECTIVE: To have the Board of County Commissioners (Board) correct a Scrivener’s Error in
Ordinance No. 2016-41.
CONSIDERATIONS: Following the Board’s adoption of Ordinance No. 2016-41 on December 13,
2016, it was determined that the PUD Document was approved for 304 total dwelling units (stated in
Exhibit “A”) while the title and Section One of the Ordinance reflected 319 dwelling units being
developed. Originally the applicant asked for 319 units, but amended the request during the Planning
Commission meeting to 304 dwelling units, which was approved by the Planning Commission and
forwarded to the Board.
The inclusion of the incorrect number of units in the title and Section One in the PUD Document now
constitutes a Scrivener’s Error.
FISCAL IMPACT: It should be noted that this amendment is only to amend incorrect number of
dwelling units allowed in Ordinance No. 2016-41 that was approved by the Board. Therefore, this change
by and of itself will have no fiscal impact on the County.
GROWTH MANAGEMENT IMPACT: The original petition was reviewed for consistency and was
found to be consistent with all the applicable provisions of the Growth Management Plan; this
amendment is only to include the corrected language to Ordinance 2016 -41 that was erroneously
approved by the Board.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires an
affirmative vote of four for Board approval.--HFAC
RECOMMENDATION: To approve the amendment to correct the scrivener’s error in Ordinance No.
2016-41.
