EXECUTIVE SUMMARY
Recommendation to approve a Resolution accepting dedications to Collier County and the Collier
County Water-Sewer District relating to the plat of Winding Cypress Phase 2C, as recorded in Plat
Book 60, Pages 22 through 28 of the Official Public Records of Collier County, Florida.

OBJECTIVE: To have the Board of County Commissioners (Board) approve a Resolution accepting
dedications to Collier County and the Collier County Water-Sewer District relating to Winding Cypress
Phase 2C.
CONSIDERATIONS: On December 15, 2015, the Board approved for recording the final plat of
Winding Cypress Phase 2C (Plat). Florida Statutes Section 177.081(2) requires that every Plat of a
subdivision filed for recording must contain a dedication by the owner or owners of records, and the
dedications must be executed by all persons, corporations, or entities whose signature would be required
to convey fee simple title to the lands being dedicated in the same manner in which deeds are required to
be executed.
In accordance with Section 10.02.04 F of the Land Development Code (LDC), prior to recording of the
Plat, the applicant submitted the final executed Plat to the County al ong with a Title Opinion. The Title
Opinion indicated that as of December 6, 2015, record title to the property was vested in Divosta Homes,
L.P. Accordingly, the Plat dedications were executed by only Divosta Homes, L.P. The Plat was then
recorded on January 11, 2016.
LDC Section 10.02.04 F, requires that within 60 days of the Plat recording, the applicant must submit a
“gap” title opinion covering the period of time between the effective date of the original title opinion and
the date of plat recording (in this case, December 6, 2015 through January 11, 2016). Subsequent to the
Plat recording, but prior to submitting the gap title opinion, the applicant informed the County that a
portion of the Plat property was conveyed in fee simple to the Winding Cyp ress Community
Development District (CDD) by Special Warranty Deed recorded on January 8, 2016. Therefore, the
CDD was record owner of a portion of the Plat property prior to the Plat recording. As such, the CDD
now wishes to execute the Plat dedications by recording the attached Consent and Joinder to the
Dedications and Reservations for the Plat.
The dedications to Collier County and the Collier County Water-Sewer District constitute an offer to
dedicate and require acceptance by the Board. The dedications on the Plat to the County include all
drainage easements, lake maintenance easements, access easements, and preserve areas. The dedications
to the Water-Sewer District include all county utility easements and applicable utility systems (upon
acceptance by the Board in accordance with the County’s Utilities Standards and Procedures).
FISCAL IMPACT: There is no fiscal impact associated with this action. The applicant will pay the
required recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval. - SAS
RECOMMENDATION: To approve the attached Resolution accepting dedications to Collier County
and the Collier County Water-Sewer District within the Plat of Winding Cypress Phase 2C, as recorded in
