Agenda 03/14/2017 Item #16A1103/14/2017 EXECUTIVE SUMMARY Recommendation to approve the release of a code enforcement lien with a value of $17,102.64 for payment of $4,052.64 in the code enforcement actions the entitled Board of County Commissioners v. Esteban Hernandez, Code Enforcement Board Case No. CEPM20110003003, relating to property located at 701 E. Delaware Avenue, Collier County, Florida. OBJECTIVE: That the Board of County Commissioners (Board) accepts an offer to release a code enforcement lien with an accrued value of $17,102.64 for payment of $4,052.64 in relation to Code Enforcement Board Case No. CEPM20110003003. CONSIDERATIONS: As a result of code violations, the Code Enforcement Board ordered the imposition of a lien against Esteban Hernandez in Case No. CEPM20110003003, for code violations at 701 E. Delaware Avenue, consisting of a mobile home with numerous property maintenance violations on the interior and the exterior of structure/building causing a health and safety issue to the community. The lien was recorded in the Official Records on September 13, 2011, at O.R. Book 4718, Page 1326. The lien amount of $17,102.64 is based on 54 days of accrued fines ($250 per day from April 7, 2011 through May 30, 2011) $13,500, plus operational costs in the amount of $112.64 and abatement costs of $3,490. The property was brought into compliance on May 30, 2011. The property was acquired by CC Tax LLC., via Tax Deed Sale recorded on April 17, 2014. Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code enforcement lien encumbers property that is under new ownership and compliance has been achieved within 30 days. The new owner is actively maintaining the property and $4,052.64 has been paid in settlement of fines. The owner is requesting a waiver of $13,050 in accrued fines. There are currently no known violations. FISCAL IMPACT: Payment of $4,052.64 in settlement of fines has been paid, representing $450 in fines, operational costs in the amount of $112.64 and $3,490 in abatement costs. If approved by the Board, accrued fines in the amount of $13,050 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2012-46. - KN RECOMMENDATION: To waive the fines in the amount of $13,050, accept the payment amount of $4,052.64, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records.
