EXECUTIVE SUMMARY
Recommendation to adopt an Ordinance repealing Ordinance No. 1978-49, in its entirety, which
created the Isles of Capri Municipal Fire Services Taxing District, accept the September 6, 2016
Inventory List, as the final inventory list to be transferred to the Greater Naples Fire Rescue
District (GNFD), remit any remaining MSTU funds to GNFD upon completing of audited financial
statements, and terminate the Agreement between the parties.
OBJECTIVE: To formalize the annexation of the Isles of Capri Fire District into the Greater Naples
Fire Rescue District by repealing the Ordinance that created the MSTU.
CONSIDERATIONS: Collier County adopted Ordinance No. 1978-49 creating the MSTU for the
purpose of providing rescue and fire control services to all the residents situated within the Isles of
Capri’s boundaries. On March 25, 2016, the Governor House Bill 1265 signed into law (Chapter 2016 -
261, Laws of Florida), providing for the annexation of the MSTU’s service area into the Greater Na ples
Fire Rescue District (the “District”) upon approval of a referendum by the majority of the resident
electors within the MSTU.
On August 30, 2016, the resident electors of the MSTU approved a referendum supporting the annexation
of the fire service area into the District. At its February 14, 2017 regular meeting, the Board of County
Commissioners authorized staff to advertise the proposed Ordinance.
In addition to repealing the Ordinance, staff requests Board approval to: (1) accept the September 6,
2016, final asset and inventory list and transfer the assets and inventory in the list to the Greater Naples
Fire Rescue District, (2) remit any remaining MSTU funds to GNFD upon completion of audited
financial statements; and (3) terminate, as satisfied, the interlocal agreement between the County and
GNFD.
FISCAL IMPACT: The cost to advertise the proposed Ordinance was $154.96. The net book of the
transferred assets is $169,939.43. The final fund balance amount will be determined sometime after the
close of the fiscal year.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority
vote for Board approval.-SRT
RECOMMENDATION: To approve the following:
1. Adapt the attached Ordinance repealing Ordinance No. 1979-49 in its entirety.
2. Accept September 6, 2016 asset and inventory list and transfer the assets and inventory in the list
to the Greater Naples Fire Rescue District;
3. Authorize staff to remit any remaining MSTU funds to GNFD upon completion of audited
financial statements; and
4. Terminate, as satisfied, the interlocal agreement between the County and GNFD.
