EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign a Collier County Landscape
Maintenance Agreement (“Agreement”) between Collier County and RaceTrac Petroleum, Inc. for
landscape improvements within the Radio Road right-of-way.
OBJECTIVE: That the Board of County Commissioners (Board) approves and authorizes the Chairman
to sign the attached Collier County Landscape Maintenance Agreement permitting landscaping
improvements within the County right-of-way and ensuring RaceTrac Petroleum, Inc. will maintain
improvements accordingly.
CONSIDERATIONS: Collier County was approached by RaceTrac Petroleum, Inc. to install sod and
irrigation adjacent to the RaceTrac development within the Radio Road public right -of-way. Pursuant to
the attached Landscape Maintenance Agreement, the owner agrees to maintain the sod and irrigation
improvements. Rights to terminate the agreement are spelled out in the attached agreement.
FISCAL IMPACT: There is no cost to Collier County associated with this proposal. RaceTrac
Petroleum Inc. is responsible for all recording fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this

LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval -SAS.
RECOMMENDATION: To sign a Collier County Landscape Maintenance Agreement between Collier
County and RaceTrac Petroleum, Inc. for landscape improvements within the Radio Road right-of-way.
