Agenda 02/14/2017 Item #16E 302/14/2017 EXECUTIVE SUMMARY Recommendation to direct the County Attorney to advertise the repeal of Ordinance No. 1978-49, as amended, which created the Isles of Capri Municipal Fire Services Taxing District. OBJECTIVE: To complete the annexation of the Isles of Capri Fire District into the Greater Naples Fire Rescue District. CONSIDERATIONS: Collier County adopted Ordinance No. 1978-49 creating the MSTU for the purpose of providing rescue and fire control services to all the residents situated within the Isles of Capri’s boundaries. On March 25, 2016, the Governor House Bill 1265 signed into law (Chapter 2016-261, Laws of Florida), providing for the annexation of the MSTU’s service area into the Greater Naples Fire Rescue District (the “District”) upon approval of a referendum by the majority of the resident electors within the MSTU. On August 30, 2016, the resident electors of the MSTU approved a referendum supporting the annexation of the fire service area into the District. Staff is seeking permission to advertise the repeal of Ordinance No. 1978- 49, so the Board can consider formally removing this law from the Code of Laws and Ordinances of Collier County, Florida. Should the request to advertise be authorized, staff will come back to the Board at that time with a report addressing the following: The Interlocal agreement dated September 8, 2015 between the County and GNFD is satisfied and requesting that it be terminated. An inventory and inspection of all supplies, vehicles, and equipment located within the Isles of Capri Fire Station or otherwise owned by the Isles of Capri fire district jointly conducted on September 6, 2016, which was accepted by both parties. An evaluation of the remaining MSTU funds was completed and the funds can be transferred to GNFD upon completion of the audited financial statements. FISCAL IMPACT: The approximate cost to advertise the proposed Ordinance is $200. GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.-SRT RECOMMENDATION: That the Board of County Commissioners approves and authorizes the County Attorney to advertise an Ordinance repealing Ordinance No. 1978-49.
