Agenda 02/14/2017 Item #16E 202/14/2017 EXECUTIVE SUMMARY Recommendation to direct the County Attorney to advertise the repeal of Ordinance No. 2015-18, which created the Fiddlers Creek Municipal Rescue and Fire Services District. OBJECTIVE: To complete the annexation of the Fiddlers Creek Municipal Rescue and Fire District into the Greater Naples Fire Rescue District. CONSIDERATIONS: Collier County adopted Ordinance No. 2015-18 creating the MSTU to provide and maintain fire department services within the Fiddlers Creek boundaries. On June 10, 2015, the Governor signed House Bill 859 into law (Chapter 2015-188, Laws of Florida), which provided for the annexation of the MSTU service area into the Greater Naples Fire Rescue District (the “District”) upon an affirmative vote by the majority of the resident electors within the MSTU. On March 15, 2016, the resident electors of the MSTU approved a referendum allowing for the annexation of its service area into the Greater Naples Fire District. Staff is seeking authorization to advertise the attached proposed Ordinance repealing Ordinance No. 2015-18, so that the Board can consider formally removing this law from the Code of Laws and Ordinances of Collier County, Florida. Should the request to advertise be authorized, staff will also come back to the Board at that time with: (1) a request to terminate the February 24, 2015, interim fire service management Interlocal Agreement between the County and the District, (2) a request to remit any remaining financial reserves, fund balance or carry forward amounts in the MSTU pending the completion of audited financial statements. FISCAL IMPACT: The approximate cost to advertise the proposed Ordinance is $200. GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.-SRT RECOMMENDATION: That the Board of County Commissioners approves, and authorizes the County Attorney to advertise an Ordinance repealing Ordinance No. 2015-18.
