Agenda 02/14/2017 Item #16E 102/14/2017 EXECUTIVE SUMMARY Recommendation to direct the County Attorney to advertise the repeal of Ordinance No. 1984-84, which created the Collier County Fire Control Municipal Service Taxing Unit. OBJECTIVE: To formalize the annexation of the Collier County Fire Control Municipal Service Taxing Unit (the “MSTU”) into the Greater Naples Fire Rescue District by repealing the Ordinance that created the MSTU. CONSIDERATIONS: Collier County adopted Ordinance No. 1984-84 creating the Collier County Fire Control Municipal Service Taxing Unit for the purpose of providing fire protection to all the residents situated within the unincorporated areas of Collier County lying outside the boundaries of an existing fire control taxing district. On March 25, 2016, the Governor signed into law Chapter 2016-262, Laws of Florida, providing for the annexation of the MSTU’s service area into the Greater Naples Fire Rescue District (the “District”) upon approval of a referendum by the majority of the resident electors within th e MSTU. On August 30, 2016, the resident electors of the MSTU approved a referendum supporting the annexation of the fire service area into the District. The official certification of the election results made the transfer of the fire service area into the District final as a matter of law. Staff is seeking permission to advertise the repeal of Ordinance No. 1984-84, so the Board can consider formally removing this law from the Code of Laws and Ordinances of Collier County, Florida. Should the request to advertise be authorized, staff will also come back to the Board at that time with a request to remit any remaining financial reserves, fund balance or carry forward amounts in the MSTU upon the County’s completion of audited financial statements. An Interlocal Agreement between the County and the District, which provides funding for the Ochopee Fire District until such time as they are annexed into District remains in force. FISCAL IMPACT: The approximate cost to advertise the proposed Ordinance is $200. GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with this action.
