(Petitioner's request) Move Item 16A8 to Item 11D: ***This item has been continued from the January 10, 2017 BCC meeting.*** Recommendation to adopt a Resolution to hold a public hearing to consider vacating an unimproved 30-foot wide public right- of-way described as "Avenue B" and a portion of an unimproved 30-foot wide public right-of-way described as "First Street," according to the COL-LEE-CO TERRACE subdivision plat, as recorded in Plat Book 1,Page 32 of the Public Records of Collier County, Florida. The subject property is located on the south side of U.S. 41 between Frederick Street and Palm Street in Section 11, Township 50 South,Range 25 East, Collier County,Florida. (Commissioner Fiala's request) Withdraw Item 16A10: Recommendation to approve and authorize the County Manager or his designee to execute an after the fact deductive Change Order No. 2 to Earth Tech Enterprises, 2016 Beach Renourishment under Contract No. 16-7009. (This deductive change order item was included in the Change Order Report (16E8) in today's Consent Agenda.) 02/14/2017 ,EXECUTIVE SUMMARY Recommendation to approve and authorize the County Manager or his designee to execute an after the fact deductive Change Order No. 2 to Earth Tech Enterprises, 2016 Beach Renourishment under Contract No. 16-7009. OBJECTIVE: To execute a deductive Change Order (No. 2) for Earth Tech Enterprises, for a net decrease in the contract total of $37,143. This change order will decrease the Marco Island portion of the beach renourishment project by $56,993 and includes additional scope of work for the Sugden Lake sand material delivery which added $19,850 for a net decrease of $37,143. CONSIDERATIONS: The means and methods associated with the placement of the sand materials at the South Marco Island Beach Renourishment portion of the project was modified by implementing a direct truck haul placement to the beach location as opposed to the previous mechanical conveyance system for the placement of the materials, that was described in the solicitation. This change will result in a $56,993 decrease to the Marco Island portion of the project. Additional scope of work was also included for the Sugden Lake sand material delivery by adding the contractor’s services for the placement and distribution of the sand material at three different site locations. The placement and distribution of the sand materials was originally scheduled to be performed by County staff; this addition adds $19,850 to the total cost of the Sugden Lake Regional Park portions of the Project. No construction activities have or will take place after the previously approved completion date of 1/2/2017. All changes made in this change order were made in the field to benefit the project or is intended to decrease the quantities of material to what was actually used. A work directive was issued to the contractor to execute these changes. Between these two changes there will be a net decrease of $37,143 on this project. PROCUREMENT ACTION: Invitation to Bid (ITB) No. 16-7009 was posted on August 25, 2016 and approved by the Board of County Commissioners on October 11, 2016 (item 11B). Notices were sent to 2090 firms and 77 firms downloading full packages. Eight (8) responses were received on the September 26, 2016, due date. The Board of County Commissioners (Board) local vendor preference policy was not included in this solicitation given that grant stipulations require full and open competition. However, Earth Tech Enterprises, Inc., is a local contractor with principle offices in Naples, FL. FISCAL IMPACT: There is no Fiscal Impact associated with this Executive Summary. This is a time request. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. ADVISORY COMMITTEE RECOMMENDATIONS: The original Work Order was approved by the Coastal Advisory Committee (CAC) on October 12, 2016; the Tourist Development Council (TDC) on October 25, 2016, and the Board of County Commissioners (Board) on October 11, 2016.
